<p><i>English will follow</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Inukjuak au Directeur des poursuites criminelles et pénales le 14 février 2019.&nbsp; À la suite de sa décision de ne pas porter d’accusation contre les policiers impliqués, le BEI ferme le dossier BEI-2018-007.</p> <p><strong>Résumé de l’événement</strong></p> <p>Billy Nutaraq, un homme de 44 ans, est décédé lors d’une intervention policière du Corps de police régional de Kativik le vendredi 16 mars 2018.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales.</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement&nbsp;: 00 h 30<br />Heure du signalement au BEI&nbsp;: 19 h 40<br />Déclenchement de l’enquête&nbsp;: 19 h 42</p> <p>Le BEI a déployé 6 enquêteurs qui, avec le support d’un technicien en identité judiciaire de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 18 h 00 le 17 mars 2018 et a terminé l’examen de la scène vers 22 h 45.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de 2 témoins civils, incluant un médecin. Il a également analysé les faits rapportés par les 2 policiers impliqués.&nbsp;</p> <p>Toutes les exigences relatives au délai pour rencontrer les policiers impliqués prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées. Following the DPCP’s decision not to lay charges against the police officers involved, the BEI is closing file BEI-2018-007.</p> <p class="text-justify"><strong>Summary of the Event</strong></p> <p class="text-justify">Billy Nutaraq, a 44-year-old man, died during a police intervention by the Kativik Regional Police Force on Friday, March&nbsp;16,&nbsp;2018. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales.</p> <p class="text-justify"><strong>The independent investigation</strong></p> <ul><li><p class="text-justify"><span>Time of the event&nbsp;: 12:30&nbsp;a.m.</span></p></li><li><p class="text-justify"><span>Time of reporting to the BEI&nbsp;:&nbsp;7:40&nbsp;p.m.</span></p></li><li><p class="text-justify"><span>Time the investigation was launched&nbsp;:&nbsp;7:42&nbsp;p.m.</span></p></li></ul> <p class="text-justify">The BEI deployed six investigators who, with the assistance of a forensic identification technician from the Sûreté du Québec, were tasked with shedding light on this event. During the initial deployment, the team arrived at the scene at approximately 6:00&nbsp;p.m. on March&nbsp;17,&nbsp;2018, and completed the examination of the scene at approximately 10:45&nbsp;p.m.</p> <p class="text-justify">In this case, the BEI gathered testimony from two civilian witnesses, including a doctor. It also analyzed the facts reported by the two police officers involved.</p> <p class="text-justify">All requirements regarding the timeframe for meeting with the involved police officers, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were met. In this case, there were no witness police officers within the meaning of the Regulation.</p> <p class="text-justify">The information obtained during the investigation indicates that the obligations of the involved police officers and of the director of the police force concerned, as provided for in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were not met.</p> <p class="text-justify">However, the Director of the BEI considered this to be an exceptional situation and did not deem it necessary to notify the director of the police force of the regulatory breaches for the following reasons&nbsp;:</p> <ul><li><p class="text-justify"><span>Only four police officers work in this village.</span></p></li><li><p class="text-justify"><span>They had to secure the scene and the body of the man while continuing to respond to calls.</span></p></li><li><p class="text-justify"><span>They were informed by their captain of the procedure applicable in the case of an independent investigation.</span></p></li><li><p class="text-justify"><span>Due to weather conditions, the captain was unable to travel to the village and could not deploy additional police officers to allow the police officers involved to be withdrawn from the case.</span></p></li></ul> <p class="text-justify">The content of all interviews was submitted to the DPCP.</p> <p class="text-justify">The BEI investigation report included, among other things&nbsp;:</p> <ul><li><p class="text-justify"><span>The statements from the involved police officers, required by the Regulation</span></p></li><li><p class="text-justify"><span>Reports from the Kativik Regional Police Force concerning the event</span></p></li><li><p class="text-justify"><span>Training records of the involved police officers</span></p></li><li><p class="text-justify"><span>Various expert reports deemed necessary, including biology and toxicology</span></p></li><li><p class="text-justify"><span>Relevant personal information concerning the civilian involved</span></p></li><li><p class="text-justify">The autopsy report</p></li><li><p class="text-justify">Scene examination reports</p></li><li><p class="text-justify"><span>Control report and tracking of seized items</span></p></li><li><p class="text-justify"><span>All notes taken by BEI investigators regarding the case</span></p></li></ul> <p class="text-justify">In addition, the BEI appointed an investigator to serve as liaison with the family of the civilian involved throughout the process, ensuring they were kept informed of the progress and outcome of the investigation.</p> <p class="text-justify"><i>The mission of the Bureau des enquêtes indépendantes is to fully shed light on the facts surrounding police interventions. <p><i>English will follow</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Inukjuak le 16 mars 2018 au cours duquel un civil de 44 ans est décédé lors d'une intervention policière du Corps de police régional Kativik.</p> <p>L’enquête démontre les faits suivants&nbsp;:</p> <p>Le 15 mars, en soirée, des policiers sont appelés pour une situation de violence conjugale.&nbsp; Ils se rendent à la résidence où s’est réfugiée une dame. Ils la transportent à l’hôpital pour y faire soigner ses blessures. Le 16 mars, vers minuit trente, les policiers se rendent à son domicile pour s’assurer que personne d’autre n’est blessé et y trouvent Billy Nunarak à genou, le torse appuyé sur un matelas déposé au sol. Il semble être en état d’ébriété, inconscient, mais il respire. Les policiers sont incapables de le réveiller. Ils le positionnent sur le côté, sur le lit.&nbsp;</p> <p>Vers 13 h 20, le même jour, un autre policier retourne sur les lieux pour procéder à son arrestation et découvre qu’il est décédé.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales et au Bureau du coroner le 14 février 2018.&nbsp; C’est sur la base de ce rapport que le DPCP déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.</p> <p>Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. They go to the residence where a woman has taken refuge. They transport her to the hospital to have her injuries treated. On March&nbsp;16, at approximately 12:30&nbsp;a.m., police officers go to her residence to ensure that no one else is injured and find Billy Nunarak kneeling, with his torso resting on a mattress placed on the floor. He appears to be intoxicated, unconscious, but breathing. The police officers are unable to wake him. They position him on his side, on the bed.</p> <p class="text-justify">At approximately 1:20&nbsp;p.m. the same day, another police officer returns to the scene to proceed with his arrest and discovers that he has died.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) and to the Bureau du Coroner on February&nbsp;14,&nbsp;2018. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from the persons involved and witnesses, as well as items of evidence.
