<p><i>English will follow</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Waskaganish au Directeur des poursuites criminelles et pénales (DPCP) le 21 mai 2019.&nbsp;Ce dernier a demandé un complément d’enquête au BEI le 24 septembre 2019 qui a répondu à la requête le 19 mars 2020.</p> <p>À la suite de la décision du DPCP de ne pas porter d’accusation contre les policiers impliqués, le BEI ferme le dossier BEI-2018-001.</p> <p><strong>Résumé de l’événement</strong></p> <p>Brandon Stephen, un homme de 24 ans, est décédé lors de sa détention par le Eeyou Eenou Police Force le mardi 2 janvier 2018.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du DPCP.</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement&nbsp;: 12 h 15 le 1er janvier 2018<br />Heure du signalement au BEI&nbsp;: 08h 00 le 2 janvier 2018<br />Déclenchement de l’enquête&nbsp;: 08 h 40 le 2 janvier 2018</p> <p>Le BEI a déployé 6 enquêteurs qui, avec le support d’un technicien en identité judiciaire de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 19 h 30 le 2 janvier et a terminé l’examen de la scène vers 02 h 20 le 3 janvier.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de 16 témoins civils, incluant ceux rencontrés dans le cadre du complément d’enquête. On&nbsp;September&nbsp;24,&nbsp;2019, the DPCP requested further investigation from the BEI, which responded to this request on March&nbsp;19,&nbsp;2020.</p> <p class="text-justify">Following the DPCP’s decision not to lay charges against the police officers involved, the BEI is closing file BEI-2018-001.</p> <p class="text-justify"><strong>Summary of the Event</strong></p> <p class="text-justify">Brandon Stephen, a 24-year-old man, died while in the custody of the Eeyou Eenou Police Force on Tuesday, January&nbsp;2,&nbsp;2018. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales.</p> <p class="text-justify"><strong>The Independent Investigation</strong></p> <ul><li><p class="text-justify"><span>Time of the event&nbsp;: 12:15&nbsp;p.m. on January&nbsp;1,&nbsp;2018</span></p></li><li><p class="text-justify"><span>Time of reporting to the BEI&nbsp;:&nbsp;8:00&nbsp;a.m. on January&nbsp;2,&nbsp;2018</span></p></li><li><p class="text-justify"><span>Time the investigation was launched&nbsp;:&nbsp;8:40&nbsp;a.m. on January&nbsp;2,&nbsp;2018</span></p></li></ul> <p class="text-justify">The BEI deployed six investigators who, with the assistance of a forensic identification technician from the Sûreté du Québec, were tasked with shedding light on this event. During the initial deployment, the team arrived at the scene at approximately 7:30&nbsp;p.m. on January&nbsp;2 and completed the scene examination at approximately 2:20&nbsp;a.m. on January&nbsp;3.</p> <p class="text-justify">In this case, the BEI collected testimony from 16&nbsp;civilian witnesses, including those interviewed as part of the further investigation. <p><i>English will follow</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Waskaganish le 2 janvier 2018 au cours duquel un civil de 24 ans est décédé lors de sa détention par le Eeyou Eenou Police Force.</p> <p>L’enquête démontre les faits suivants&nbsp;:</p> <p>Le 1^er janvier 2018, vers 11 h 00, un policier se rend à une résidence suite à une plainte. Il trouve sur place un homme et, à sa demande, le reconduit près de chez sa mère.</p> <p>Ce même policier est appelé à intervenir à nouveau auprès de l’homme vers 12 h 15. Il est cette fois dans une fête avec d’autres individus et il tient des propos suicidaires. Le policier le prend en charge et décide de le mettre en cellule au poste puisqu’il est en état d’ébriété avancé.</p> <p>À 22 h 57, alors que le sujet est en cellule, il se plaint de douleurs au niveau de l’estomac. Il est transféré par ambulance à la clinique médicale de Waskaganish où il décède à 3 h 00 le lendemain matin. L’homme sera identifié par Bureau du coroner comme étant Brandon Stephen, un homme de 24 ans qui résidait à Waskaganish.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales et au Bureau du coroner le 23 mai 2019. The police officer finds a man at the scene and, at the man’s request, drives him to an area near his mother’s home.</p> <p class="text-justify">The same police officer is called to intervene again with the man at around 12:15&nbsp;p.m. On this occasion, the man is attending a party with other individuals and is making suicidal statements. The officer takes charge of the man and decides to place him in a cell at the police station due to his advanced state of intoxication.</p> <p class="text-justify">At 10:57&nbsp;p.m., while the individual is in a cell, he complains of stomach pain. He is transported by ambulance to the Waskaganish medical clinic, where he dies at 3:00&nbsp;a.m. the following morning. The man will be identified by the Bureau du Coroner as Brandon Stephen, a 24-year-old man who resided in Waskaganish.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) and to the Bureau du Coroner on May&nbsp;23,&nbsp;2019. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from the persons involved and witnesses, as well as items of evidence.
