<p><i>Ensligh will follow&nbsp;</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Puvirnituq au Directeur des poursuites criminelles et pénales le 14 septembre 2018. À la suite de sa décision de ne pas porter d’accusation contre les policiers impliqués, le BEI ferme le dossier BEI-2017-016.</p> <p><strong>Résumé de l’événement</strong></p> <p>Jimmy Éliyassialuk, un homme de 22 ans est décédé pendant sa détention par le Corps de police régional Kativik le vendredi 28 avril 2017. La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales.</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement : 17 h 15</p> <p>Heure du signalement au BEI : 19 h 00</p> <p>Déclenchement de l’enquête : 19 h 03</p> <p>Le BEI a déployé 7 enquêteurs qui, avec le support de 1 technicien en identité judiciaire de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 13 h 30 le 29 avril et a terminé l’examen de la scène vers 20 h 40.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de 19 témoins civils, incluant des médecins. Il a également analysé les faits rapportés par les 3 policiers impliqués et les 3 policiers autres directement liés à l’événement.</p> <p>Toutes les exigences relatives au délai pour rencontrer les policiers impliqués prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées. Dans ce dossier, il n’y avait aucun policier témoin au sens du Règlement.</p> <p>Les informations obtenues pendant l’enquête permettent de conclure que les obligations des policiers impliqués et du directeur du corps de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes n’ont pas été respectées.</p> <p>Plus particulièrement, le BEI a constaté que l’article 1, alinéa 2 et alinéa 4 et article 2, alinéa 2 du Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes n’ont pas été respectés.</p> <p>Le contenu de toutes les entrevues a été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:</p> <p>- Les comptes rendus des policiers impliqués exigés par le Règlement;</p> <p>- Les rapports du Corps de police régional Kativik concernant l’événement;</p> <p>- Le dossier de formation des policiers impliqués;</p> <p>- Les différents rapports d’expertise jugés nécessaires, notamment en biologie;</p> <p>- Les informations personnelles pertinentes concernant le civil impliqué;</p> <p>- Des séquences vidéo telles que filmées par des caméras de surveillance sur place;</p> <p>- Le rapport d’autopsie;</p> <p>- Les rapports d’étude de la scène;</p> <p>- Les rapports de contrôle et de suivi des pièces saisies;</p> <p>- Les extraits pertinents des calepins de notes des enquêteurs du BEI.</p> <p>De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec la famille du civil impliqué et l’informer du déroulement ainsi que de la conclusion de celle-ci.</p> <p><i>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.  </i></p> <p class="text-justify"><strong>Independent investigation into the incident that occurred in Puvirnituq on April&nbsp;28,&nbsp;2017&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the event that occurred in Puvirnituq to the Directeur des poursuites criminelles et pénales on April&nbsp;28,&nbsp;2017. Following the DPCP’s decision not to lay charges against the police officers involved, the BEI is closing file BEI-2017-016.</p> <p class="text-justify"><strong>Summary of the Event</strong></p> <p class="text-justify">Jimmy Éliyassialuk, a 22-year-old man, died while in the custody of the Kativik Regional Police Force on Friday, April&nbsp;28,&nbsp;2017. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales.</p> <p class="text-justify"><strong>The independent investigation</strong></p> <ul><li><p class="text-justify"><span>Time of the event&nbsp;:&nbsp;5:15&nbsp;p.m.</span></p></li><li><p class="text-justify"><span>Time of reporting to the BEI&nbsp;:&nbsp;7:00&nbsp;p.m.</span></p></li><li><p class="text-justify"><span>Time the investigation was launched&nbsp;:&nbsp;7:03&nbsp;p.m.</span></p></li></ul> <p class="text-justify">The BEI deployed seven investigators who, with the assistance of a forensic identification technician from the Sûreté du Québec, were tasked with shedding light on this event. During the initial deployment, the team arrived at the scene at approximately 1:30&nbsp;p.m. on April&nbsp;29 and completed the scene examination at approximately 8:40&nbsp;p.m.</p> <p class="text-justify">In this case, the BEI collected testimony from 19&nbsp;civilian witnesses, including doctors. It also analyzed the facts reported by the three police officers involved and the three other police officers directly connected to the event.</p> <p class="text-justify">All requirements regarding the timeframe for meeting with the involved police officers, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were met.</p> <p class="text-justify">In this case, there were no witness police officers within the meaning of the Regulation.</p> <p class="text-justify">The information obtained during the investigation indicates that the obligations of the involved police officers and of the director of the police force involved, as defined in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were not respected.</p> <p class="text-justify">More specifically, the BEI found that section&nbsp;1, subsections&nbsp;2 and 4, and section&nbsp;2, subsection&nbsp;2 of the Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes were not respected.</p> <p class="text-justify">The content of all interviews was submitted to the DPCP.</p> <p class="text-justify">The BEI investigation report included, among other things&nbsp;:</p> <ul><li><p class="text-justify"><span>The statements from the involved police officers, as required by the Regulation;</span></p></li><li><p class="text-justify"><span>Reports from the Kativik Regional Police Force regarding the event;</span></p></li><li><p class="text-justify"><span>Training records of the police officers involved;</span></p></li><li><p class="text-justify"><span>Various expert reports deemed necessary, including biology;</span></p></li><li><p class="text-justify"><span>Relevant personal information concerning the civilian involved;</span></p></li><li><p class="text-justify"><span>Video footage, including recordings from on-site surveillance cameras;</span></p></li><li><p class="text-justify">The autopsy report;</p></li><li><p class="text-justify">Scene examination reports;</p></li><li><p class="text-justify"><span>Reports on the control and tracking of seized evidence;</span></p></li><li><p class="text-justify"><span>Relevant excerpts from the BEI investigators’ notebooks.</span></p></li></ul> <p class="text-justify">In addition, the BEI appointed an investigator to serve as liaison with the family of the civilian involved throughout the process, ensuring they were kept informed of the progress and outcome of the investigation.</p> <p class="text-justify"><i>The mission of the Bureau des enquêtes indépendantes is to conduct investigations in all cases where a person, other than an on-duty police officer, dies, sustains a serious injury, or is injured by a firearm used by a police officer during a police intervention or while in the custody of a police force.</i></p>

<p><i>English will follow&nbsp;</i></p> <p>Le BEI a complété son enquête indépendante&nbsp;sur les circonstances entourant un événement survenu à Puvirnituq le 28 avril 2017 au cours duquel un civil de 22 ans est décédé pendant sa détention par le Corps de police régional de Kativik.</p> <p>L’enquête démontre les faits suivants&nbsp;:&nbsp;</p> <p>Vers 9 h 33 le 28 avril, des policiers du Corps de police régional de Kativik amènent un homme de 22 ans fortement intoxiqué dans une cellule du poste de police de Puvirnituq. L’homme est déposé sur un matelas à même le sol.</p> <p>Vers 17 h 13, un gardien civil du bloc cellulaire indique aux policiers que l’homme qui est toujours étendu dans la même position ne réagit pas à ses sollicitations et qu’il ne semble pas respirer. Deux policiers arrivent environ 2 minutes plus tard au poste et tentent sans succès des manœuvres de réanimation sur l’homme. The man is placed on a mattress on the floor.</p> <p class="text-justify">At approximately 5:13&nbsp;p.m., a civilian cellblock guard informs police officers that the man, who is still lying in the same position, is unresponsive to attempts to wake him and does not appear to be breathing. Two police officers arrive at the station approximately two minutes later and unsuccessfully attempt resuscitation maneuvers. The man is transported to the hospital, where his death is pronounced.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) and to the Bureau du Coroner on September&nbsp;14,&nbsp;2018. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from involved individuals and witnesses, as well as evidence.
