<p><i>English will follow&nbsp;</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Maliotenam au Directeur des poursuites criminelles et pénales ainsi qu’au Bureau du coroner, puisqu’il y a eu décès.&nbsp; À la suite de la décision du Directeur des poursuites criminelles et pénales de ne pas porter d’accusation contre les policiers impliqués, le BEI ferme le dossier BEI-2016-005.</p> <p><strong>Résumé de l’événement</strong></p> <p>Marius Fontaine, un homme de 59 ans, est décédé lors d’une intervention de la Sécurité publique Uashat Mak Mani-Utenam (SPUMM) le vendredi 26 août 2016.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales.</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement&nbsp;: 09h39<br />Heure du signalement au BEI&nbsp;: 10h19<br />Déclenchement de l’enquête&nbsp;: 10h27</p> <p>Le BEI a déployé 9 enquêteurs qui, avec le support d’un technicien de scène de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Following the DPCP’s decision not to lay charges against the police officers involved, the BEI is closing file&nbsp;BEI-2016-005.</p> <p class="text-justify"><strong>Summary of the incident</strong></p> <p class="text-justify">Marius Fontaine, a 59-year-old man, died during an intervention by the Uashat Mak Mani-Utenam Public Security (SPUMM) on Friday, August&nbsp;26,&nbsp;2016. <p><i>English will follow&nbsp;</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant l’événement survenu à Maliotenam le 26 août 2016, au cours duquel Marius Fontaine, un homme de 59 ans résident de Maliotenam, est décédé.</p> <p>L’enquête démontre les faits suivants&nbsp;:</p> <p>Le 26 août, vers 09 h 38, deux policiers en possession d’un mandat d’arrestation se rendent au domicile de Marius Fontaine pour procéder à son arrestation. L’homme se trouve à l’intérieur.&nbsp; Le policier cogne à la porte et l’individu lui ouvre.</p> <p>Le policier s’identifie, l’informe de l’existence du mandat d’arrestation et lui demande de l’accompagner au poste. Il ajoute qu’il sera arrêté afin de comparaître à la cour et qu’il sera remis en liberté sous conditions dans la journée. Marius Fontaine accepte, mais demande la permission d’aller se changer, ce à quoi le policier acquiesce.</p> <p>Puisqu’ils n’ont pas de mandat d’entrée, le policier et sa collègue venue le rejoindre restent à l’extérieur. Soudainement, ils entendent une détonation provenant de l’intérieur. Le policier défonce la porte verrouillée. Une fois à l’intérieur, les policiers constatent que l’homme a, sur lui, une arme à feu pointée vers sa tête et qu’il a une importante blessure à la tête. Il s’agit d’une mort évidente.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales le 13 juin 2017. C’est sur la base de ce rapport que le DPCP déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.</p> <p>Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. Conséquemment aucune autre information sur les faits ou sur l’enquête ne sera divulguée par le BEI.</p> <p class="text-justify"><strong>Independent investigation regarding the event that occurred in Maliotenam on August&nbsp;26,&nbsp;2016&nbsp;:&nbsp;the BEI submits its investigation report to the Directeur des poursuites criminelles et pénales</strong></p> <p class="text-justify">The BEI has completed its independent investigation into the circumstances surrounding an event that occurred in Maliotenam on August&nbsp;26,&nbsp;2016, during which Marius Fontaine, a 59-year-old resident of Maliotenam, died.</p> <p class="text-justify">The investigation found the following facts&nbsp;:</p> <p class="text-justify">On August&nbsp;26, at approximately 9:38&nbsp;a.m., two police officers in possession of an arrest warrant go to Marius Fontaine’s residence to carry out his arrest. The man is inside. One of the police officers knocks on the door and the individual answers.</p> <p class="text-justify">The police officer identifies himself, informs him of the arrest warrant, and asks him to accompany him to the police station. He adds that he is under arrest to appear in court and will be released later that day under conditions. Marius Fontaine agrees, but asks for permission to change clothes, which the police officer grants.</p> <p class="text-justify">As they do not have a warrant to enter the residence, the police officer and his colleague, who joins him, remains outside. Suddenly, they hear a gunshot from inside. The police officer forces open the locked door. Once inside, the police officers observe that the man has a firearm pointed at his head and has sustained a significant head injury. The death is apparent.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales on June&nbsp;13,&nbsp;2017. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from the persons involved and witnesses, as well as items of evidence. Consequently, no further information regarding the facts or the investigation will be disclosed by the BEI.</p>
