Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 23 h 30, le 4 septembre 2021.</p> <p class="text-justify">Dans ce dossier, le BEI a recueilli le témoignage de 10 témoins civils. Il a aussi analysé les faits rapportés par les policiers en relation avec l'intervention.</p> <p class="text-justify">Les informations obtenues pendant l’enquête permettent de conclure que les obligations du policier impliqué et du directeur du Service de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le dossier d’enquête comportant les éléments de ce dernier a été remis au DPCP pour analyse et décision. Le dossier comprend les composantes suivantes :</p> <ul><li><span>Les comptes rendus des policiers du NPS exigés par le Règlement ;</span></li><li><span>Les documents du NPS tels que les rapports d’événements et les rapport des agents ;</span></li><li><span>Le rapport de toxicologie du LSJML ;</span></li><li><span>Le rapport d’analyse du reconstitutionniste en collision du Service de police de la Ville de Montréal, le corps de police de soutien ainsi que le rapport d’inspection mécanique ;</span></li><li><span>Le rapport des techniciens en identité judiciaire du&nbsp;Service de police de la Ville de Montréal qui a effectué la scène et les notes de l’enquêteur de scène du BEI ;</span></li><li><span>Toutes les notes des enquêteurs du BEI concernant le dossier.</span></li></ul> <p class="text-justify">De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec la famille du civil impliqué et l’informer de son déroulement et de sa conclusion.</p> <p class="text-justify"><i>Le Bureau des enquêtes indépendantes a pour mission de faire la lumière complète sur les faits entourant l’intervention policière. Le BEI enquête dans tous les cas où une personne, autre qu'un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d'une intervention policière ou durant sa détention par un corps de police.</i></p> <p class="text-justify"><br /><strong>Independent investigation into the incident that occurred in Aupaluk on September 3, 2021: Summary of the BEI investigation</strong></p> <p class="text-justify">In accordance with the Police Act, the BEI submitted its investigation report on the incident in Aupaluk to the Directeur des poursuites criminelles et pénales (DPCP) on December 14, 2021. Following the DPCP's decision not to lay charges against the police officer involved, and in the absence of new evidence, the BEI is closing file BEI-2021-036. With the judicial proceedings concluded, the BEI is publishing its summary of the investigation following the <a href="https://www.quebec.ca/nouvelles/actualites/details/enquete-independante-sur-levenement-survenu-a-aupaluk-le-3-septembre-2021-motifs-pour-lesquels-aucune-accusation-na-ete-portee-68850">DPCP's press release outlining the reasons for its detailed decision.</a></p> <p class="text-justify"><strong>Summary of the Event</strong></p> <p class="text-justify">On September 3, 2021, a person died during an intervention involving the Nunavik Police Service (NPS). The factual account of this event is outlined in the press release from the Director of Criminal and Penal Prosecutions.</p> <p class="text-justify"><strong>The Independent Investigation</strong></p> <ul><li><p class="text-justify"><span>Time of the event: 11:10 p.m., September 3, 2021</span></p></li><li><p class="text-justify"><span>Time of notification to the BEI: 6:38 a.m., September 4, 2021</span></p></li><li><p class="text-justify"><span>Investigation launched: 6:55 a.m., September 4, 2021</span></p></li></ul> <p class="text-justify">The BEI deployed seven investigators tasked with shedding light on this event. During the initial deployment, the team arrived on scene around 11:30 p.m. on September 4, 2021.</p> <p class="text-justify">In this case, the BEI collected testimony from 10 civilian witnesses. It also analyzed the facts reported by the police officers regarding the intervention.</p> <p class="text-justify">The information obtained during the investigation leads to the conclusion that the obligations of the police officer involved and the director of the police service involved, as stipulated in the Regulation respecting the conduct of investigations by the Bureau des enquêtes indépendantes (BEI), were met.</p> <p class="text-justify">The investigation file, containing the elements of this file, was submitted to the DPCP for analysis and decision. The file includes the following components:</p> <p class="text-justify">The NPS police reports required by the Regulations;</p> <ul><li><p class="text-justify"><span>NPS documents such as incident reports and officer reports;</span></p></li><li><p class="text-justify"><span>The LSJML toxicology report;</span></p></li><li><p class="text-justify"><span>The collision reconstruction analysis report from the Montreal Police Service, the support police force, and the mechanical inspection report;</span></p></li><li><p class="text-justify"><span>The report from the Montreal Police Service forensic identification technicians who conducted the scene investigation and the notes from the BEI scene investigator;</span></p></li><li><p class="text-justify"><span>All notes from BEI investigators concerning the case.</span></p></li></ul> <p class="text-justify">Furthermore, the BEI had appointed an investigator to liaise with the family of the civilian involved throughout the investigation, keeping them informed of its progress and conclusion.</p> <p class="text-justify"><i>The BEI’s mandate is to fully investigate the facts surrounding police interventions. The BEI investigates all cases where a person, other than a police officer on duty, dies, suffers serious injury, or is injured by a firearm used by a police officer during a police intervention or while in police custody.</i></p>

Following the DPCP’s decision not to lay charges against the police officers involved, the BEI is closing file BEI-2021-036.</p> <p class="text-justify">As the file relating to the parallel investigation conducted by the Service de police de la Ville de Montréal (SPVM) is still under review, and as charges could potentially be laid against a civilian involved in the incident, the BEI will not release any further information at this time. <p><i>English will follow</i></p> <p>Le BEI déclenche une enquête indépendante à Aupaluk sur les circonstances d’une intervention&nbsp;impliquant le Nunavik Police Service (NPS).&nbsp;&nbsp;</p> <p>Les renseignements préliminaires communiqués au BEI suggèrent ce qui suit :</p> <ul><li>Le 3 septembre 2021, vers&nbsp;23 h 00, une plainte pour bruit excessif aurait été logée au&nbsp;CPRK en lien avec la présence de plusieurs VTT dans le village de Aupaluk.</li><li>Un policier du&nbsp;CPRK, arrivé sur les lieux peu après, aurait localisé quatre ou cinq VTT.</li><li>Les VTT auraient pris la fuite après que les occupants aient aperçu le véhicule du policier.</li><li>Le policier aurait alors activé ses gyrophares, mais pris la décision de suivre les VTT à distance.</li><li>Plus loin, le policier aurait rejoint les VTT et aurait constaté que deux d’entre eux étaient entrés en collision.</li><li>Une des occupantes, âgée de 14 ans, aurait été grièvement blessée dans la collision.</li><li>Son décès a par la suite été constaté au dispensaire.</li></ul> <p>Cinq enquêteurs du BEI se rendront sur les lieux.</p> <p>Conformément au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes,&nbsp;l’enquête parallèle a été confiée au Service de police de la Ville de&nbsp;Montréal (SPVM) et ce dernier agira aussi en tant que corps de police de soutien dans cette enquête.</p> <p>Aucune autre information n’est disponible pour le moment.</p> <p>Le BEI demande à quiconque aurait été témoin de cet événement de communiquer avec lui via son site web au&nbsp;<a href="http://www.bei.gouv.qc.ca/ _blank">www.bei.gouv.qc.ca</a>.</p> <p class="text-justify"><strong>The BEI announces the launch of an investigation in Aupaluk</strong></p> <p class="text-justify">The BEI is launching an independent investigation in Aupaluk concerning the circumstances of an intervention involving the Nunavik Police Service (NPS).</p> <p class="text-justify">Preliminary information provided to the BEI suggests the following&nbsp;:</p> <ul><li><p class="text-justify"><span>On September&nbsp;3,&nbsp;2021, at around 11:00&nbsp;p.m., a complaint of excessive noise was reportedly filed with the NPS in connection with the presence of several ATVs in the village of Aupaluk.</span></p></li><li><p class="text-justify"><span>A NPS police officer, who arrived on the scene shortly afterward, reportedly located four or five ATVs.</span></p></li><li><p class="text-justify"><span>The ATVs allegedly fled after their occupants noticed the police vehicle.</span></p></li><li><p class="text-justify"><span>The police officer then reportedly activated his emergency lights but chose to follow the ATVs from a distance.</span></p></li><li><p class="text-justify"><span>Further along, the police officer reportedly caught up with the ATVs and noticed that two of them had collided.</span></p></li><li><p class="text-justify"><span>One of the occupants, a 14-year-old girl, was reportedly seriously injured in the collision.</span></p></li><li><p class="text-justify"><span>She was later pronounced dead at the local clinic.</span></p></li></ul> <p class="text-justify">Five BEI investigators will be deployed to the scene.</p> <p class="text-justify">In accordance with the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, the parallel investigation has been assigned to the Service de police de la Ville de Montréal (SPVM), which will also act as the supporting police force in this investigation.</p> <p class="text-justify">No further information is available at this time.</p> <p class="text-justify">The BEI asks anyone who may have witnessed the event to contact them via their website at&nbsp;<a href="https://www.bei.gouv.qc.ca/nous-joindre.html" target="_blank">www.bei.gouv.qc.ca/nous joindre</a>.</p>
