<p><i>English will follow</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Chisasibi au Directeur des poursuites criminelles et pénales ainsi qu’au Bureau du coroner, puisqu’il y a eu décès.&nbsp; À la suite de la décision du Directeur des poursuites criminelles et pénales de ne pas porter d’accusation contre les policiers impliqués, le BEI ferme le dossier BEI-2016-010.</p> <p><strong>Résumé de l’événement</strong></p> <p>Cody Bobbish, un homme de 19 ans, est décédé lors d’une intervention de la Eeyou Eenou Police Force le dimanche 2 octobre 2016.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales.</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement&nbsp;: 21h42, le 2 octobre 2016<br />Heure du signalement au BEI&nbsp;: 00h21, le 3 octobre 2016<br />Déclenchement de l’enquête&nbsp;: 00h30, le 3 octobre 2016</p> <p>Le BEI a déployé 7 enquêteurs qui, avec le support d’un technicien de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée dans la région du Nord-du-Québec le 03 octobre à 13 h 15 et a quitté le 4 octobre en après-midi.&nbsp; L’examen de la scène s’est terminé vers 01h00 le matin du 4 octobre.</p> <p>Dans ce dossier, le BEI a rencontré 13 témoins civils, incluant des ambulanciers ainsi que 5 policiers.</p> <p>Le policiers témoin et les 3 policiers impliqués ont tous été rencontrés dans les délais légaux prévus au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes, soit respectivement 24 heures et 48 heures&nbsp;suivant l’arrivée des enquêteurs du BEI sur les lieux de l’événement.</p> <p>Les informations obtenues pendant l’enquête permettent de conclure que certaines obligations des différents acteurs décrites dans le Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes n’ont pas été respectées.</p> <p>Le policier témoin et les policiers impliqués dans ce dossier ont communiqué entre eux au sujet de l’événement avant de rédiger leur compte rendu et de rencontrer les enquêteurs du BEI, contrairement à leur obligation de s’abstenir de le faire mentionnée au point 1.4 du Règlement.&nbsp;</p> <p>Il ressort des entrevues que ce Règlement en vigueur depuis le 27 juin 2016 était inconnu des policiers de la Eeyou Eenou Police Force qui ont pleinement collaboré avec les enquêteurs du BEI tout au long de l’enquête. Following the Directeur des poursuites criminelles et pénales decision not to lay charges against the police officers involved, the BEI is closing file BEI-2016-010.</p> <p class="text-justify"><strong>Summary of the Incident</strong></p> <p class="text-justify">Cody Bobbish, a 19-year-old man, died during an intervention by the Eeyou Eenou Police Force on Sunday, October&nbsp;2,&nbsp;2016. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales.</p> <p class="text-justify"><strong>The Independent Investigation</strong></p> <ul><li><p class="text-justify"><span>Time of the event&nbsp;:&nbsp;9:42&nbsp;p.m., October&nbsp;2,&nbsp;2016</span></p></li><li><p class="text-justify"><span>Time of reporting to the BEI&nbsp;:&nbsp;12:21&nbsp;a.m., October&nbsp;3,&nbsp;2016</span></p></li><li><p class="text-justify"><span>Time the investigation was launched&nbsp;<strong>:</strong>&nbsp;12:30&nbsp;a.m., October&nbsp;3,&nbsp;2016</span></p></li></ul> <p class="text-justify">The BEI deployed seven investigators who, with the assistance of a technician from the Sûreté du Québec, were tasked with shedding light on this event. During the initial deployment, the team arrived in the Northern Quebec region on October&nbsp;3 at 1:15&nbsp;p.m. and left on the afternoon of October&nbsp;4. The scene examination concluded at approximately 1:00&nbsp;a.m. on October&nbsp;4.</p> <p class="text-justify">In this case, the BEI met with 13&nbsp;civilian witnesses, including paramedics, as well as five police officers.</p> <p class="text-justify">The witness police officer and the three police officers involved were all met within the legal time limits set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, namely within 24&nbsp;hours and 48&nbsp;hours respectively after the BEI investigators arrived at the scene.</p> <p class="text-justify">The information obtained during the investigation indicates that certain obligations of the various actors described in the Regulation were not respected.</p> <p class="text-justify">The witness police officer and the police officers involved in this case communicated with each other about the event before drafting their reports and before meeting with BEI investigators, contrary to their obligation to refrain from doing so as stated in section&nbsp;1.4 of the Regulation.</p> <p class="text-justify">Interviews indicate that this Regulation, in effect since June&nbsp;27,&nbsp;2016, was unknown to the police officers of the Eeyou Eenou Police Force, who nevertheless fully cooperated with BEI investigators throughout the investigation. <p><i>English will follow&nbsp;</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant l’événement survenu à Chisasibi le 2 octobre 2016, au cours duquel Cody Bobbish, un civil de 18 ans résident de Chisasibi, est décédé lors d’une intervention policière.</p> <p>L’enquête démontre les faits suivants&nbsp;:</p> <p>Vers 21h00 le 2 octobre 2016, un premier appel est parvenu au Service de police Eeyou Eenou Police Force qui indiquait que Cody Bobbish voulait utiliser une arme de chasse en sa possession pour se suicider.</p> <p>Arrivés sur les lieux vers 21h12, les policiers ont constaté que l’homme était armé et se trouvait dans le portique entre la porte extérieure verrouillée et la porte d’entrée de la maison. Ils ont tenté en vain de parlementer avec lui pendant plusieurs minutes. Soudainement, l’homme a appuyé l’arme contre sa poitrine et a fait feu. Il a déposé son arme et s’est dirigé vers l’intérieur de la maison. Les policiers ont alors défoncé la porte extérieure, l’ont rejoint à l’intérieur où il s’était écroulé et lui ont prodigué les premiers soins. Son décès a été constaté à l’hôpital à 23h12.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales (DPCP) le 1^er mai 2017.&nbsp; C’est sur la base de ce rapport que le DPCP déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.</p> <p>Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve.&nbsp; Conséquemment, aucune autre information sur les faits ou sur l’enquête ne sera divulguée par le BEI.</p> <p class="text-justify"><strong>Independent investigation regarding the event that occurred in Chisasibi&nbsp;:&nbsp;the BEI submits its investigation report to the Directeur des poursuites criminelles et pénales</strong></p> <p class="text-justify">The BEI has completed its independent investigation into the circumstances surrounding the event that occurred in Chisasibi on October&nbsp;2,&nbsp;2016, during which Cody Bobbish, an 18-year-old civilian and resident of Chisasibi, died during a police intervention.</p> <p class="text-justify">The investigation found the following facts&nbsp;:</p> <p class="text-justify">At approximately 9:00&nbsp;p.m. on October&nbsp;2,&nbsp;2016, an initial call was received by the Eeyou Eenou Police Force indicating that Cody Bobbish wanted to use a hunting weapon in his possession to commit suicide.</p> <p class="text-justify">Arriving at the scene at approximately 9:12&nbsp;p.m., the police officers observed that the man was armed and standing in the vestibule between the locked exterior door and the front door of the house. They attempted unsuccessfully to negotiate with him for several minutes. Suddenly, the man pressed the weapon against his chest and fired. He put down his weapon and went inside the house. The police officers then forced open the exterior door, reached him inside where he had collapsed, and administered first aid. His death was pronounced at the hospital at 11:12&nbsp;p.m.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) on May&nbsp;1,&nbsp;2017. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from the persons involved and witnesses, as well as items of evidence. Consequently, no further information regarding the facts or the investigation will be disclosed by the BEI.</p>
