Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Kuujuaq le 26 octobre 2018 au cours duquel une civile de 19 ans est décédée lors d'une intervention policière du Corps régional de police de Kativik.
L’enquête démontre les faits suivants :
Vers 8 h 25, un appel est logé au poste du Corps de police régional de Kativik à l’effet qu’un coup de feu a été entendu dans une maison voisine de l’appelant. Des policiers se rendent sur les lieux et discutent avec ce dernier qui affirme avoir entendu plusieurs autres coups de feu provenant de la même maison. Les policiers érigent un périmètre de sécurité et se postent à l’avant et à l’arrière de la résidence. L’un d’eux aperçoit une femme assise, à l’intérieur. Elle parle au téléphone avec un des policiers qui lui demande de sortir de la maison, en ne tenant rien dans ses mains et en les gardant levées. La civile informe qu’elle obtempèrera et la communication téléphonique se termine. Le policier informe alors ses collègues de la sortie possible de la femme. Au même moment, les policiers entendent un bruit important provenant de l’intérieur. Ils demandent du renfort à d’autres policiers pour établir un périmètre plus large. Aucun autre bruit n’est alors entendu et aucun mouvement n’est aperçu dans la résidence entre 8 h 45 et 9 h 50. Les policiers entrent alors par la porte principale et découvrent le corps de Penina Adams, gisant au sol de la chambre à coucher, une arme sous elle. Elle est transportée à l’hôpital où son décès est constaté.
Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales et au Bureau du coroner le 9 octobre 2019. C’est sur la base de ce rapport que le DPCP déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.
Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. Conséquemment, aucune autre information sur les faits ou sur l’enquête ne sera divulguée par le BEI.
Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu'un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d'une intervention policière ou durant sa détention par un corps de police.
Independent investigation concerning the event that occurred in Kuujjuaq on October 26, 2018 : the BEI submits its investigation report to the Directeur des poursuites criminelles et pénales
The BEI has completed its independent investigation into the circumstances surrounding an event that occurred in Kuujjuaq on October 26, 2018, during which a 19-year-old civilian died during a police intervention by the Kativik Regional Police Force.
The investigation found the following facts :
At approximately 8:25 a.m., a call was placed to the Kativik Regional Police Force station reporting that a gunshot had been heard in a house near the caller’s residence. Police officers attended the scene and spoke with the caller, who stated that several additional gunshots had been heard coming from the same house. The police officers established a security perimeter and positioned themselves at the front and rear of the residence. One police officer observed a woman seated inside the house. She spoke by telephone with one of the police officers, who asked her to exit the house without holding anything in her hands and with her hands raised. The civilian indicated that she would comply, and the telephone communication ended. The police officer then informed his colleagues of the woman’s possible exit.
At the same time, the police officers heard a loud noise coming from inside the residence. They requested assistance from additional police officers to establish a wider perimeter. No further noise was heard and no movement was observed inside the residence between 8:45 a.m. and 9:50 a.m. The police officers then entered through the main door and discovered the body of Penina Adams lying on the bedroom floor, with a firearm underneath her. She was transported to hospital, where her death was pronounced.
In accordance with the Police Act, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) and to the Bureau du Coroner on October 9, 2019. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.
It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from involved individuals and witnesses, as well as evidence. Consequently, no further information regarding the facts or the investigation will be released by the BEI.
The mission of the Bureau des enquêtes indépendantes is to fully shed light on the facts surrounding police interventions. The BEI investigates all cases in which a person other than an on-duty police officer dies, suffers a serious injury, or is injured by a firearm discharged by a police officer during a police intervention or while in police custody.
