Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 20 h 10 le 5 septembre 2018 et a terminé l’examen de la scène vers 19 h 15, le 6 septembre 2018.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de 24 témoins civils, incluant des premiers répondants. Il a également analysé les faits rapportés par les trois policiers impliqués, les six policiers témoins et&nbsp;les quatre policiers autres directement liés à l’événement. &nbsp;</p> <p>Toutes les exigences relatives au délai pour rencontrer les policiers impliqués et les policiers témoins prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.&nbsp;<br /><br />Les informations obtenues pendant l’enquête permettent de conclure que les obligations des policiers témoins, des policiers impliqués et du directeur du corps de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le contenu de toutes les entrevues a été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:<br />-&nbsp;Les comptes rendus des policiers impliqués et témoins exigés par le Règlement<br />-&nbsp;Les rapports du KRPF et de la SQ concernant l’événement<br />-&nbsp;Les différents rapports d’expertise jugés nécessaires, notamment en toxicologie et en balistique judiciaire<br />- Les informations personnelles pertinentes concernant le civil impliqué<br />- Les séquences vidéo qui concernent l’événement, telles que filmées par des témoins civils&nbsp;<br />- Le rapport d’autopsie<br />-&nbsp;Les rapports d’étude de la scène&nbsp;<br />-&nbsp;Les rapports de contrôle et de suivi des pièces saisies<br />-&nbsp;Toutes les notes des enquêteurs du BEI concernant le dossier.<br /><br />De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec la famille du civil impliqué et l’informer de son déroulement et de sa conclusion.</p> <p><i>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</i></p> <p class="text-justify"><strong>Independent investigation into the incident that occurred in Inukjuak on September&nbsp;5,&nbsp;2018&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the incident that occurred in Inukjuak to the Directeur des poursuites criminelles et pénales on August&nbsp;15,&nbsp;2019. Following the DPCP’s decision not to lay charges against the police officers involved, the BEI is closing file BEI-2018-028.</p> <p class="text-justify"><strong>Summary of the incident</strong></p> <p class="text-justify">Tommy Ningiuk, a 40-year-old man, died during a police intervention by the Kativik Regional Police Force (KRPF) and the Sûreté du Québec (SQ) on Wednesday, September&nbsp;5,&nbsp;2018. The factual sequence of events is outlined in the &nbsp;press release issued by the DPCP.</p> <p class="text-justify"><strong>Independent Investigation</strong></p> <ul><li><p class="text-justify"><span>Date and time of the event&nbsp;: September&nbsp;4,&nbsp;2018 – 8:30&nbsp;p.m.</span></p></li><li><p class="text-justify"><span>Date and time of reporting to the BEI&nbsp;:&nbsp;September&nbsp;5,&nbsp;2018 – 11:52&nbsp;a.m.</span></p></li><li><p class="text-justify"><span>Date and time the investigation was launched&nbsp;:&nbsp;September&nbsp;5,&nbsp;2018 – 12:00&nbsp;p.m.</span></p></li></ul> <p class="text-justify">The BEI deployed six investigators who, with the assistance of two forensic identification technicians from the Service de police de la Ville de Montréal, were tasked with shedding light on this event. During the initial deployment, the team arrived at the scene at approximately 8:10&nbsp;p.m. on September&nbsp;5,&nbsp;2018, and completed the examination of the scene at approximately 7:15&nbsp;p.m. on September&nbsp;6,&nbsp;2018.</p> <p class="text-justify">In this case, the BEI collected testimony from 24&nbsp;civilian witnesses, including first responders. <p><i>English will follow</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Inukjuak le 5 septembre 2018 au cours duquel un civil de 40 ans est décédé lors d'une intervention policière du Corps de police régional de Kativik (KRPF) et de la Sûreté du Québec&nbsp;(SQ).</p> <p>L’enquête démontre les faits suivants&nbsp;:</p> <p>Le 4 septembre 2018, vers 20&nbsp;h&nbsp;30, un plaignant informe des policiers du KRPF qu’un homme tire des coups de feu, à partir de son domicile, en direction du voisinage et de personnes circulant sur la route. &nbsp;En arrivant sur les lieux vers 20&nbsp;h&nbsp;35, les policiers voient l’homme à l’extérieur de sa résidence tirer plusieurs coups de feu dans diverses directions, puis entrer dans son domicile. Les policiers établissent un périmètre de sécurité autour de la résidence. Vers 20&nbsp;h&nbsp;50, un policier du KRPF entre en contact téléphonique avec l’homme et apprend que ce dernier est avec trois autres personnes dans sa résidence. Le KRPF demande alors l’assistance de la SQ.<br />Une opération pour homme armé et barricadé est déclenchée par la SQ vers 23&nbsp;h. En attendant l’arrivée du groupe d’intervention de la SQ, les policiers du KRPF poursuivent l’évacuation des résidences avoisinantes et prennent place sur le périmètre établi autour de la résidence, sous le commandement à distance d’un officier de la SQ.<br />Vers 05 h15 du matin, le 5 septembre 2018, des négociations téléphoniques sont entreprises entre l’homme et un négociateur de la SQ. L’homme consent à laisser sortir les 3 personnes qui sont avec lui. Vers 11&nbsp;h, l’homme sort à l’extérieur de sa résidence, muni d’une arme et tire en direction des policiers. L’homme est atteint par le tir d’un policier du KRPF. Des manœuvres de réanimation sont entreprises par les policiers et par les premiers répondants. Le décès de Tommy Ningiuk est constaté vers 11&nbsp;h&nbsp;42.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales et au Bureau du coroner le 15 août 2019.&nbsp; C’est sur la base de ce rapport que le <a class="dpnglossary link" href="https://www.bei.gouv.qc.ca/actualites/detail.html#DPCP" title="Directeur des poursuites criminelles et pénales">DPCP</a> déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.</p> <p>Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. Upon arriving at the scene around 8:35&nbsp;p.m., police officers observed the man outside his residence firing several gunshots in various directions before entering his home. The police officers established a security perimeter around the residence. At approximately 8:50&nbsp;p.m., a KRPF police officer made telephone contact with the man and learned that he was inside the residence with three other individuals. The KRPF then requested the assistance of the SQ.</p> <p class="text-justify">An operation for armed and barricaded person was initiated by the SQ around 11:00&nbsp;p.m. While awaiting the arrival of the SQ tactical unit, KRPF police officers continued evacuating nearby residences and positioned themselves on the established perimeter around the residence, under the remote command of an SQ officer.</p> <p class="text-justify">At approximately 5:15&nbsp;a.m. on September&nbsp;5,&nbsp;2018, telephone negotiations began between the man and an SQ negotiator. The man agreed to allow the three individuals who were with him to exit the residence. Around 11:00&nbsp;a.m., the man exited his residence armed and fired in the direction of the police officers. The man was struck by a shot fired by a KRPF police officer. Resuscitation efforts were undertaken by the police officers and first responders. The death of Tommy Ningiuk was pronounced at approximately 11:42&nbsp;a.m.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) and to the Bureau du Coroner on August&nbsp;15,&nbsp;2019.
