Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Kahnawake le 8 décembre 2019 au cours duquel un civil de 30 ans est décédé lors d'une intervention policière des Peacekeepers de Kahnawake.
L’enquête démontre les faits suivants :
Le 8 décembre 2019 vers 18h10, un appel est fait au 9-1-1 par un proche de la famille d’un homme à l’effet qu’il se désorganise et endommage sa résidence. Deux policiers se rendent sur les lieux et constatent que la porte avant du domicile n'est pas verrouillée. Ils décident d’y entrer.
Une fois à l’intérieur, les policiers annoncent leur présence. Entendant du bruit venant du sous-sol, les policiers s’y dirigent. L’homme, muni d’une arme à feu, leur demande de quitter la résidence.
Les agents retournent à l’extérieur du domicile et appellent des renforts afin d’établir un périmètre de sécurité. Plusieurs tentatives sont faites dans les heures qui suivent pour entrer en contact avec l’homme, via son cellulaire et de vive voix, en vain.
Vers 21h00, les policiers voient l’homme sortir à l’extérieur de sa résidence avec une arme, la pointer dans leur direction et retourner à l’intérieur. L’homme tire ensuite à quelques reprises vers les policiers, de l’intérieur de la résidence.
Vers 21h40, l’homme sort à nouveau de sa résidence, armé, se dirige vers un véhicule qui est dans le stationnement et prend place à bord. Les policiers, qui tentent alors une approche du véhicule, entendent une déflagration d’arme à feu. L’homme a retourné son arme contre lui.
Le sujet est transporté à l'Hôpital général de Montréal où son décès est constaté.
Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales et au Bureau du coroner le 17 août 2020. C’est sur la base de ce rapport que le DPCP déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.
Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. Conséquemment, aucune autre information sur les faits ou sur l’enquête ne sera divulguée par le BEI.
Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu'un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d'une intervention policière ou durant sa détention par un corps de police.
Independent investigation concerning the event that occurred in Kahnawake on December 8, 2019 : the BEI submits its investigation report to the Directeur des poursuites criminelles et pénales
The BEI has completed its independent investigation into the circumstances surrounding an incident that occurred in Kahnawake on December 8, 2019, during which a 30-year-old civilian died during a police intervention by the Kahnawake Peacekeepers.
The investigation found the following facts :
On December 8, 2019, around 6:10 p.m., a call was made to 9-1-1 by a relative of a man’s family to the effect that he was disorganizing himself and damaging his residence. Two police officers went to the residence and found that the front door was unlocked. They decided to enter.
Once inside, the police officers announced their presence. Hearing noises coming from the basement, the police officers proceeded in that direction. The man, who was armed with a firearm, ordered them to leave the residence.
The police officers exited the home and called for reinforcements to establish a security perimeter. Several attempts were made over the following hours to contact the man, by phone and verbally, without success.
Around 9:00 p.m., the police officers saw the man exit his residence with a firearm, point it in their direction, and then return indoors. The man then fired several shots toward the police officers from inside the residence.
Around 9:40 p.m., the man again exited the residence, armed, walked toward a vehicle in the driveway, and got inside. As the police officers were attempting to approach the vehicle, they heard a gunshot. The man had turned his weapon on himself.
He was transported to the Montréal General Hospital, where his death was confirmed.
In accordance with the Police Act, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) and to the Bureau du Coroner on August 17, 2020. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.
It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from involved individuals and witnesses, as well as evidence. Consequently, no further information regarding the facts or the investigation will be released by the BEI.
The mission of the Bureau des enquêtes indépendantes is to fully shed light on the facts surrounding police interventions. The BEI investigates all cases in which a person other than an on-duty police officer dies, suffers a serious injury, or is injured by a firearm discharged by a police officer during a police intervention or while in police custody.
