<p><i>English will follow</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Kahnawake au Directeur des poursuites criminelles et pénales (DPCP) le 17 août 2020.&nbsp; À la suite de la décision du DPCP de ne pas porter d’accusation contre les policiers impliqués, le BEI ferme le dossier BEI-2019-035.</p> <p><strong>Résumé de l’événement</strong></p> <p>Gerald Alexander Marquis, un homme de 29 ans, est décédé lors d’une intervention policière des Peacekeepers de Kahnawake le dimanche 8 décembre 2019.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du DPCP.</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement&nbsp;: 18 h 10<br />Heure du signalement au BEI&nbsp;: 23 h 50<br />Déclenchement de l’enquête&nbsp;: 09 h 00 – 9 décembre 2019</p> <p>Le BEI a déployé huit enquêteurs qui, avec le support de deux techniciens en identité judiciaire du Service de police de la Ville de Montréal (SPVM), avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 10 h 50 le 9 décembre 2019 et a terminé l’examen de la scène vers 23 h 55.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de 19 témoins civils. Il a également analysé les faits rapportés par le policier impliqué et les vingt policiers autres directement liés à l’événement. &nbsp;</p> <p>Toutes les exigences relatives au délai pour rencontrer le policier impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.&nbsp;<br />Dans ce dossier, il n’y avait aucun policier témoin au sens du Règlement.</p> <p>Les informations obtenues pendant l’enquête permettent de conclure que les obligations du policier impliqué et du directeur du corps de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le contenu de toutes les entrevues a été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:<br />-&nbsp;Les comptes rendus du policier impliqué exigés par le Règlement<br />-&nbsp;Les rapports des Peacekeepers de Kahnawake concernant l’événement, incluant les cartes d’appels et les enregistrements pertinents des ondes radio<br />-&nbsp;Les différents rapports d’expertise jugés nécessaires, notamment en toxicologie et en balistique judiciaire<br />-&nbsp;Les informations personnelles pertinentes concernant le civil impliqué&nbsp;<br />- Les photos et séquences vidéo qui concernent l’événement, telles que prises par des témoins civils<br />- Les rapports d’étude de la scène&nbsp;<br />-&nbsp;Les rapports de contrôle et de suivi des pièces saisies<br />-&nbsp;Toutes les notes des enquêteurs du BEI concernant le dossier.<br /><br />De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec la famille du civil impliqué et l’informer de son déroulement et de sa conclusion.</p> <p><i>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</i></p> <p class="text-justify"><strong>Independent investigation into the incident that occurred in Kahnawake on December&nbsp;8,&nbsp;2019&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the incident that occurred in Kahnawake to the Directeur des poursuites criminelles et pénales on August&nbsp;17,&nbsp;2020. Following the DPCP’s decision not to lay charges against the police officers involved, the BEI is closing file BEI-2019-035.</p> <p class="text-justify"><strong>Summary of the Event</strong></p> <p class="text-justify">Gerald Alexander Marquis, a 29-year-old man, died during a police intervention by the Kahnawake Peacekeepers on Sunday, December&nbsp;8,&nbsp;2019. The factual sequence of events is outlined in the press release issued by the DPCP.</p> <p class="text-justify"><strong>Independent Investigation</strong></p> <ul><li><p class="text-justify"><span>Time of the event&nbsp;: 6:10&nbsp;p.m.</span></p></li><li><p class="text-justify"><span>Time of reporting to the BEI&nbsp;:&nbsp;11:50&nbsp;p.m.</span></p></li><li><p class="text-justify"><span>Time the investigation was launched&nbsp;:&nbsp;9:00&nbsp;a.m. – December&nbsp;9,&nbsp;2019</span></p></li></ul> <p class="text-justify">The BEI deployed eight investigators who, with the assistance of two forensic identification technicians from the Service de police de la Ville de Montréal (SPVM), were tasked with shedding light on this event. During the initial deployment, the team arrived at the scene at approximately 10:50&nbsp;a.m. on December&nbsp;9,&nbsp;2019, and completed the scene examination at approximately 11:55&nbsp;p.m.</p> <p class="text-justify">In this case, the BEI collected testimony from 19&nbsp;civilian witnesses. It also analyzed the facts reported by the police officers involved and by the 20&nbsp;other police officers directly connected to the event.</p> <p class="text-justify">All requirements regarding the time frame to meet with the involved police officers, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were met. <p><i>English will follow</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Kahnawake le 8 décembre 2019 au cours duquel un civil de 30 ans est décédé lors d'une intervention policière des Peacekeepers de Kahnawake.</p> <p>L’enquête démontre les faits suivants&nbsp;:</p> <p>Le 8 décembre 2019 vers 18h10, un appel est fait au 9-1-1 par un proche de la famille d’un homme à l’effet qu’il se désorganise et endommage sa résidence.&nbsp; Deux policiers se rendent sur les lieux et constatent que la porte avant du domicile n'est pas verrouillée. Ils décident d’y entrer.<br />Une fois à l’intérieur, les policiers annoncent leur présence. Entendant du bruit venant du sous-sol, les policiers s’y dirigent. L’homme, muni d’une arme à feu, leur demande de quitter la résidence.<br />Les agents retournent à l’extérieur du domicile et appellent des renforts afin d’établir un périmètre de sécurité. Plusieurs tentatives sont faites dans les heures qui suivent pour entrer en contact avec l’homme, via son cellulaire et de vive voix, en vain.<br />Vers 21h00, les policiers voient l’homme sortir à l’extérieur de sa résidence avec une arme, la pointer dans leur direction et retourner à l’intérieur. L’homme tire ensuite à quelques reprises vers les policiers, de l’intérieur de la résidence.<br />Vers 21h40, l’homme sort à nouveau de sa résidence, armé, se dirige vers un véhicule qui est dans le stationnement et prend place à bord. Les policiers, qui tentent alors une approche du véhicule, entendent une déflagration d’arme à feu. L’homme a retourné son arme contre lui.<br />Le sujet est transporté à l'Hôpital général de Montréal où son décès est constaté.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales et au Bureau du coroner le 17 août 2020.&nbsp; C’est sur la base de ce rapport que le <a class="dpnglossary link" href="https://www.bei.gouv.qc.ca/actualites/detail.html#DPCP" title="Directeur des poursuites criminelles et pénales">DPCP</a> déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.</p> <p>Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. Two police officers went to the residence and found that the front door was unlocked. They decided to enter.</span></p></li><li><p class="text-justify"><span>Once inside, the police officers announced their presence. Hearing noises coming from the basement, the police officers proceeded in that direction. The man, who was armed with a firearm, ordered them to leave the residence.</span></p></li><li><p class="text-justify"><span>The police officers exited the home and called for reinforcements to establish a security perimeter. Several attempts were made over the following hours to contact the man, by phone and verbally, without success.</span></p></li><li><p class="text-justify"><span>Around 9:00&nbsp;p.m., the police officers saw the man exit his residence with a firearm, point it in their direction, and then return indoors. The man then fired several shots toward the police officers from inside the residence.</span></p></li><li><p class="text-justify"><span>Around 9:40&nbsp;p.m., the man again exited the residence, armed, walked toward a vehicle in the driveway, and got inside. As the police officers were attempting to approach the vehicle, they heard a gunshot. The man had turned his weapon on himself.</span></p></li><li><p class="text-justify"><span>He was transported to the Montréal General Hospital, where his death was confirmed.</span></p></li></ul> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) and to the Bureau du Coroner on August&nbsp;17,&nbsp;2020. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from involved individuals and witnesses, as well as evidence.
