Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Inukjuak le 5 septembre 2018 au cours duquel un civil de 40 ans est décédé lors d'une intervention policière du Corps de police régional de Kativik (KRPF) et de la Sûreté du Québec (SQ).
L’enquête démontre les faits suivants :
Le 4 septembre 2018, vers 20 h 30, un plaignant informe des policiers du KRPF qu’un homme tire des coups de feu, à partir de son domicile, en direction du voisinage et de personnes circulant sur la route. En arrivant sur les lieux vers 20 h 35, les policiers voient l’homme à l’extérieur de sa résidence tirer plusieurs coups de feu dans diverses directions, puis entrer dans son domicile. Les policiers établissent un périmètre de sécurité autour de la résidence. Vers 20 h 50, un policier du KRPF entre en contact téléphonique avec l’homme et apprend que ce dernier est avec trois autres personnes dans sa résidence. Le KRPF demande alors l’assistance de la SQ.
Une opération pour homme armé et barricadé est déclenchée par la SQ vers 23 h. En attendant l’arrivée du groupe d’intervention de la SQ, les policiers du KRPF poursuivent l’évacuation des résidences avoisinantes et prennent place sur le périmètre établi autour de la résidence, sous le commandement à distance d’un officier de la SQ.
Vers 05 h15 du matin, le 5 septembre 2018, des négociations téléphoniques sont entreprises entre l’homme et un négociateur de la SQ. L’homme consent à laisser sortir les 3 personnes qui sont avec lui. Vers 11 h, l’homme sort à l’extérieur de sa résidence, muni d’une arme et tire en direction des policiers. L’homme est atteint par le tir d’un policier du KRPF. Des manœuvres de réanimation sont entreprises par les policiers et par les premiers répondants. Le décès de Tommy Ningiuk est constaté vers 11 h 42.
Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales et au Bureau du coroner le 15 août 2019. C’est sur la base de ce rapport que le DPCP déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.
Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. Conséquemment, aucune autre information sur les faits ou sur l’enquête ne sera divulguée par le BEI.
Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu'un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d'une intervention policière ou durant sa détention par un corps de police.
Independent investigation concerning the event that occurred in Inukjuak on September 5, 2018 : the BEI submits its investigation report to the Directeur des poursuites criminelles et pénales
The BEI has completed its independent investigation into the circumstances surrounding an incident that occurred in Inukjuak on September 5, 2018, during which a 40-year-old civilian died during a police intervention involving the Kativik Regional Police Force (KRPF) and the Sûreté du Québec (SQ).
The investigation found the following facts :
On September 4, 2018, at approximately 8:30 p.m., a complainant informed KRPF police officers that a man was firing gunshots from his residence toward the neighborhood and at people passing by on the road. Upon arriving at the scene around 8:35 p.m., police officers observed the man outside his residence firing several gunshots in various directions before entering his home. The police officers established a security perimeter around the residence. At approximately 8:50 p.m., a KRPF police officer made telephone contact with the man and learned that he was inside the residence with three other individuals. The KRPF then requested the assistance of the SQ.
An operation for armed and barricaded person was initiated by the SQ around 11:00 p.m. While awaiting the arrival of the SQ tactical unit, KRPF police officers continued evacuating nearby residences and positioned themselves on the established perimeter around the residence, under the remote command of an SQ officer.
At approximately 5:15 a.m. on September 5, 2018, telephone negotiations began between the man and an SQ negotiator. The man agreed to allow the three individuals who were with him to exit the residence. Around 11:00 a.m., the man exited his residence armed and fired in the direction of the police officers. The man was struck by a shot fired by a KRPF police officer. Resuscitation efforts were undertaken by the police officers and first responders. The death of Tommy Ningiuk was pronounced at approximately 11:42 a.m.
In accordance with the Police Act, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) and to the Bureau du Coroner on August 15, 2019. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.
It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from involved individuals and witnesses, as well as evidence. Consequently, no further information regarding the facts or the investigation will be released by the BEI.
The mission of the Bureau des enquêtes indépendantes is to fully shed light on the facts surrounding police interventions. The BEI investigates all cases in which a person other than an on-duty police officer dies, suffers a serious injury, or is injured by a firearm discharged by a police officer during a police intervention or while in police custody.
