<p><i>English will follow&nbsp;</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Timiskaming au Directeur des poursuites criminelles et pénales le 29 mai 2019.&nbsp; À la suite de sa décision de ne pas porter d’accusation contre le policier impliqué, le BEI ferme le dossier BEI-2018-023.</p> <p><strong>Résumé de l’événement</strong></p> <p>Hayden Bertrand Schroeder, un homme de 18 ans, est décédé lors d’une intervention policière du <i>Timiskaming First Nation Police Force</i> le mercredi 1^er août 2018.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales (DPCP).</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement&nbsp;: 18 h 10<br />Heure du signalement au BEI&nbsp;: 20 h 47<br />Déclenchement de l’enquête&nbsp;: 21 h 35</p> <p>Le BEI a déployé 7 enquêteurs qui, avec le support de deux experts en reconstitution de collision de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 08 h 30 le 2 août 2018 et a terminé l’examen de la scène vers 14 h 45.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de trois témoins civils. Il a également analysé les faits rapportés par le policier impliqué. &nbsp;</p> <p>Toutes les exigences relatives au délai pour rencontrer le policier impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées. Dans ce dossier, il n’y avait aucun policier témoin au sens du Règlement.</p> <p>Les informations obtenues pendant l’enquête permettent de conclure que les obligations du policier impliqué et du directeur du corps de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le contenu de toutes les entrevues a été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:<br />-&nbsp;Les comptes rendus du policier impliqué exigés par le Règlement<br />-&nbsp;Les rapports du Timiskaming First Nation Police Force et de la Sûreté du Québec concernant l’événement, incluant la carte d’appel et les enregistrements pertinents des ondes radio<br />-&nbsp;Les différents rapports d’expertise jugés nécessaires, notamment en toxicologie, en mécanique et en reconstitution de collision<br />-&nbsp;Les informations personnelles pertinentes concernant le civil impliqué&nbsp;<br />- Les séquences vidéo qui concernent l’événement telles que filmées par le système d’enregistrement vidéo du véhicule patrouille<br />-&nbsp;Le rapport d’autopsie<br />-&nbsp;Les rapports d’étude de la scène&nbsp;<br />- Les rapports de contrôle et de suivi des pièces saisies<br />-&nbsp;Toutes les notes des enquêteurs du BEI concernant le dossier.<br /><br />De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec la famille du civil impliqué et l’informer de son déroulement et de sa conclusion.</p> <p>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</p> <p class="text-justify"><strong>Independent investigation regarding the event that occurred in Timiskaming on August&nbsp;1,&nbsp;2018&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the event that occurred in Timiskaming to the Directeur des poursuites criminelles et pénales on May&nbsp;29,&nbsp;2019. Following the decision not to lay charges against the police officers involved, the BEI is closing file&nbsp;BEI-2018-023.</p> <p class="text-justify"><strong>Summary of the incident</strong></p> <p class="text-justify">Hayden Bertrand Schroeder, an 18-year-old man, died during a police intervention by the Timiskaming First Nation Police Force on Wednesday, August&nbsp;1,&nbsp;2018. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales (DPCP).</p> <p class="text-justify"><strong>The independent investigation</strong></p> <ul><li><p class="text-justify"><span>Time of the event&nbsp;:&nbsp;6:10&nbsp;p.m.</span></p></li><li><p class="text-justify"><span>Time of reporting to the BEI&nbsp;<strong>:</strong>&nbsp;8:47&nbsp;p.m.</span></p></li><li><p class="text-justify"><span>Time the investigation was launched&nbsp;<strong>:</strong>&nbsp;9:35&nbsp;p.m.</span></p></li></ul> <p class="text-justify">The BEI deployed seven investigators, with the assistance of two collision reconstruction experts from the Sûreté du Québec, were tasked with shedding light on this event. The team arrived on-site at approximately 8:30&nbsp;a.m. on August&nbsp;2,&nbsp;2018, and completed the scene examination at around&nbsp;2:45&nbsp;p.m.</p> <p class="text-justify">In this case, the BEI collected testimony from three civilian witnesses. <p><i>English will follow&nbsp;</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Timiskaming le 1^er&nbsp; août au cours duquel un civil de 18 ans est décédé lors d'une intervention policière du Timiskaming First Nation Police.</p> <p>L’enquête démontre les faits suivants&nbsp;:</p> <p>Le 1^er août 2018, vers 18h10, un policier du Timiskaming First Nation Police patrouille dans un véhicule lettré. Il voit un véhicule tout terrain (VTT) qui arrive en sens inverse dans sa direction. Le conducteur conduit son VTT d’une main et tient un sac dans l’autre.</p> <p>Le VTT tourne pour emprunter un chemin en accélérant rapidement. Le véhicule de patrouille arrive peu de temps après à la hauteur de ce chemin et l’emprunte également. Le policier actionne les gyrophares alors que le VTT plusieurs mètres devant commence à louvoyer d’un côté à l’autre de la rue.</p> <p>Le VTT effectue une sortie de route dans le fossé et le conducteur est projeté. L’homme est transporté au Centre hospitalier où son décès sera constaté à 19 h 40.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales et au Bureau du coroner le 29 mai 2019.&nbsp;C’est sur la base de ce rapport que le DPCP déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.</p> <p>Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. He sees an all-terrain vehicle (ATV) coming in the opposite direction to his direction. The driver is operating the ATV with one hand while holding a bag in the other.</p> <p class="text-justify">The ATV turns onto a road, accelerating rapidly. The patrol vehicle reaches the road shortly afterward and turns onto it as well. The police officer activates the emergency lights as the ATV, several meters ahead, begins weaving from side to side.</p> <p class="text-justify">The ATV eventually leaves the roadway and enters a ditch, and the driver is thrown from the vehicle. The man is transported to hospital, where his death is pronounced at 7:40&nbsp;p.m.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) and to the Bureau du Coroner on May&nbsp;29,&nbsp;2019. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from the persons involved and witnesses, as well as items of evidence.
