<p><i>English will follow</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Umiujaq au Directeur des poursuites criminelles et pénales le 20 mars 2019.&nbsp; À la suite de sa décision de ne pas porter d’accusation contre le policier impliqué, le BEI ferme le dossier BEI-2018-014.</p> <p><strong>Résumé de l’événement</strong></p> <p>Une femme de 48 ans a été blessée gravement lors d’une intervention policière du Corps de police régional Kativik le mardi 3 avril 2018.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales.</p> <p><strong>L’enquête indépendante</strong></p> <p>Le BEI est informé une première fois après l’événement, le 4 avril 2018 à 9 h 16, mais le diagnostic alors confirmé fait état d’une blessure légère (fracture au bras). Le 5 juin 2018, à la suite de la réception au BEI de nouvelles informations sur la nature des blessures subies par la dame, une enquête indépendante est alors déclenchée à 08 h 21.</p> <p>Le BEI a déployé 5 enquêteurs qui, avec le support d’un expert en reconstitution de collision de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 13 h 55 le 7 juin 2018 et a terminé l’examen de la scène vers 16 h 47.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de 10 témoins civils, incluant un ambulancier et la personne blessée. Il a également analysé les faits rapportés par le policier impliqué et le policier témoin. &nbsp;</p> <p>Les exigences relatives au délai pour rencontrer le policier impliqué et le policier témoin prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées, en tenant compte des circonstances particulières du dossier.<br /><br />Comme il nous est impossible, encore aujourd’hui, de connaître avec exactitude le moment où le corps de police a obtenu la confirmation de la nature des blessures de la civile impliquée, il nous est donc également impossible de déterminer si les obligations du policier témoin, du policier impliqué et du directeur du corps de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le contenu de toutes les entrevues a été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Les comptes rendus du policier impliqué et du policier témoin exigés par le Règlement<br />-&nbsp;&nbsp;&nbsp;&nbsp; Les rapports du Corps de police régional Kativik concernant l’événement<br />-&nbsp;&nbsp;&nbsp;&nbsp; Les différents rapports d’expertise jugés nécessaires, dont celui en reconstitution de collision<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Les informations personnelles pertinentes concernant le civil impliqué<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Les rapports d’étude de la scène&nbsp;<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Les rapports de contrôle et de suivi des pièces saisies<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Toutes les notes des enquêteurs du BEI concernant le dossier.<br /><br />De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec le civil impliqué et l’informer de son déroulement et de sa conclusion.</p> <p>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</p> <p class="text-justify"><strong>Independent investigation concerning the event that occurred in Umiujaq on April&nbsp;3,&nbsp;2018&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the event that occurred in Umiujaq to the Directeur des poursuites criminelles et pénales on March&nbsp;20,&nbsp;2019. Following the DPCP’s decision not to lay charges against the police officer involved, the BEI closed file BEI-2018-014.</p> <p class="text-justify"><strong>Summary of the Event</strong></p> <p class="text-justify">A 48-year-old woman was seriously injured during a police intervention by the Kativik Regional Police Service on Tuesday, April&nbsp;3,&nbsp;2018. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales.</p> <p class="text-justify"><strong>Independent Investigation</strong></p> <p class="text-justify">The BEI is first notified of the event on April&nbsp;4,&nbsp;2018, at 9:16&nbsp;a.m., but the confirmed diagnosis indicated a minor injury (a broken arm). On June&nbsp;5,&nbsp;2018, following the receipt at the BEI of new information regarding the nature of the woman’s injuries, an independent investigation is initiated at 8:21&nbsp;a.m.</p> <p class="text-justify">The BEI deployed five investigators who, with the assistance of a collision reconstruction expert from the Sûreté du Québec, were tasked with shedding light on this event. During the initial deployment, the team arrived on the scene at approximately 1:55&nbsp;p.m. on June&nbsp;7,&nbsp;2018, and completed the scene examination at approximately 4:47&nbsp;p.m.</p> <p class="text-justify">In this case, the BEI collected testimony from ten civilian witnesses, including a paramedic and the injured person. It also analyzed the facts reported by the police officer involved and the witness police officer.</p> <p class="text-justify">All requirements regarding the timeframe for meeting with the involved police officers and the witness police officer, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were met, taking into account the specific circumstances of the case.</p> <p class="text-justify">Since it remains impossible to determine with certainty the exact time at which the police service received confirmation of the nature of the civilian’s injuries, it is therefore impossible to determine whether the obligations of the witness police officer, the involved police officer, and the chief of the police service, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were met.</p> <p class="text-justify">The content of all interviews was submitted to the DPCP.</p> <p class="text-justify">The BEI investigation report included, among other things&nbsp;:</p> <ul><li><p class="text-justify"><span>The statements of the involved police officer and the witness police officer, required by the Regulation</span></p></li><li><p class="text-justify"><span>Reports from the Kativik Regional Police Service concerning the event</span></p></li><li><p class="text-justify"><span>Various expert reports deemed necessary, including the collision reconstruction report</span></p></li><li><p class="text-justify"><span>Relevant personal information concerning the civilian involved</span></p></li><li><p class="text-justify">Scene examination reports</p></li><li><p class="text-justify"><span>Reports on the control and tracking of seized items</span></p></li><li><p class="text-justify"><span>All notes taken by BEI investigators regarding the case</span></p></li></ul> <p class="text-justify">In addition, the BEI designated an investigator to serve as a liaison with the civilian involved throughout the process, ensuring they were kept informed of the progress and outcome of the investigation.</p> <p class="text-justify"><i>The mission of the Bureau des enquêtes indépendantes is to fully shed light on the facts surrounding police interventions. The BEI investigates all cases in which a person other than an on-duty police officer dies, suffers a serious injury, or is injured by a firearm discharged by a police officer during a police intervention or while in police custody.</i></p>

<p><i>English will follow&nbsp;</i></p> <p>Le Bureau des enquêtes indépendantes enquête sur les circonstances entourant un événement survenu à Umiujaq le 4 avril dernier alors qu’un véhicule du Corps de police régional de Kativik a heurté une femme de 48 ans.</p> <p>Le BEI a été informé une première fois peu de temps après l’événement le 4 avril, mais le diagnostic alors confirmé faisait état d’un bras cassé. Conformément au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes, le BEI n’a pas déclenché d’enquête puisque la blessure n’était pas une «blessure grave» au sens dudit Règlement.</p> <p>Les renseignements préliminaires communiqués au BEI le 4 avril suggéraient ce qui suit&nbsp;:</p> <p>- Le Corps de police régional de Kativik aurait été informé qu’une femme aurait été en possession de couteaux et aurait exprimé son intention de blesser quelqu’un<br />- Les policiers auraient localisé la dame qui marchait dans la rue armée d’un couteau<br />- En voyant le véhicule de patrouille, la femme se serait mise à courir<br />- Le véhicule l’aurait rattrapée<br />- Une collision serait survenue entre le véhicule et la dame<br />- Après évaluation au centre de santé local, la femme a été transportée à Montréal pour traiter son bras cassé.</p> <p>Suite à de nouvelles informations rapportées au BEI qui faisaient état de blessures beaucoup plus sérieuses que celles relatées le 4 avril, des démarches ont été entreprises afin de connaitre l’évolution de la situation. In accordance with the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, the BEI did not initiate an investigation at that time because the injury did not qualify as a “serious injury” under these regulations.</p> <p class="text-justify">Preliminary information provided to the BEI on April&nbsp;4 suggested the following&nbsp;:</p> <ul><li><p class="text-justify"><span>The Kativik Regional Police Force reportedly had been informed that a woman was reportedly in possession of knives and had expressed an intention to harm someone.</span></p></li><li><p class="text-justify"><span>Police officers reportedly located the woman walking in the street armed with a knife.</span></p></li><li><p class="text-justify"><span>Upon seeing the patrol vehicle, the woman reportedly began to run.</span></p></li><li><p class="text-justify"><span>The vehicle reportedly caught up with her.</span></p></li><li><p class="text-justify"><span>A collision reportedly occurred between the vehicle and the woman.</span></p></li><li><p class="text-justify"><span>After assessment at the local health center, the woman was transported to Montreal to treat her broken arm.</span></p></li></ul> <p class="text-justify">Following new information provided to the BEI indicating that the woman’s injuries were much more serious than initially reported on April&nbsp;4, steps were taken to determine the progression of her condition.
