<p><i>English will follow</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Umiujaq au Directeur des poursuites criminelles et pénales le 20 mars 2019.&nbsp; À la suite de sa décision de ne pas porter d’accusation contre le policier impliqué, le BEI ferme le dossier BEI-2018-014.</p> <p><strong>Résumé de l’événement</strong></p> <p>Une femme de 48 ans a été blessée gravement lors d’une intervention policière du Corps de police régional Kativik le mardi 3 avril 2018.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales.</p> <p><strong>L’enquête indépendante</strong></p> <p>Le BEI est informé une première fois après l’événement, le 4 avril 2018 à 9 h 16, mais le diagnostic alors confirmé fait état d’une blessure légère (fracture au bras). Le 5 juin 2018, à la suite de la réception au BEI de nouvelles informations sur la nature des blessures subies par la dame, une enquête indépendante est alors déclenchée à 08 h 21.</p> <p>Le BEI a déployé 5 enquêteurs qui, avec le support d’un expert en reconstitution de collision de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 13 h 55 le 7 juin 2018 et a terminé l’examen de la scène vers 16 h 47.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de 10 témoins civils, incluant un ambulancier et la personne blessée. Il a également analysé les faits rapportés par le policier impliqué et le policier témoin. &nbsp;</p> <p>Les exigences relatives au délai pour rencontrer le policier impliqué et le policier témoin prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées, en tenant compte des circonstances particulières du dossier.<br /><br />Comme il nous est impossible, encore aujourd’hui, de connaître avec exactitude le moment où le corps de police a obtenu la confirmation de la nature des blessures de la civile impliquée, il nous est donc également impossible de déterminer si les obligations du policier témoin, du policier impliqué et du directeur du corps de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le contenu de toutes les entrevues a été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Les comptes rendus du policier impliqué et du policier témoin exigés par le Règlement<br />-&nbsp;&nbsp;&nbsp;&nbsp; Les rapports du Corps de police régional Kativik concernant l’événement<br />-&nbsp;&nbsp;&nbsp;&nbsp; Les différents rapports d’expertise jugés nécessaires, dont celui en reconstitution de collision<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Les informations personnelles pertinentes concernant le civil impliqué<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Les rapports d’étude de la scène&nbsp;<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Les rapports de contrôle et de suivi des pièces saisies<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Toutes les notes des enquêteurs du BEI concernant le dossier.<br /><br />De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec le civil impliqué et l’informer de son déroulement et de sa conclusion.</p> <p>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</p> <p class="text-justify"><strong>Independent investigation concerning the event that occurred in Umiujaq on April&nbsp;3,&nbsp;2018&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the event that occurred in Umiujaq to the Directeur des poursuites criminelles et pénales on March&nbsp;20,&nbsp;2019. Following the DPCP’s decision not to lay charges against the police officer involved, the BEI closed file BEI-2018-014.</p> <p class="text-justify"><strong>Summary of the Event</strong></p> <p class="text-justify">A 48-year-old woman was seriously injured during a police intervention by the Kativik Regional Police Service on Tuesday, April&nbsp;3,&nbsp;2018. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales.</p> <p class="text-justify"><strong>Independent Investigation</strong></p> <p class="text-justify">The BEI is first notified of the event on April&nbsp;4,&nbsp;2018, at 9:16&nbsp;a.m., but the confirmed diagnosis indicated a minor injury (a broken arm). On June&nbsp;5,&nbsp;2018, following the receipt at the BEI of new information regarding the nature of the woman’s injuries, an independent investigation is initiated at 8:21&nbsp;a.m.</p> <p class="text-justify">The BEI deployed five investigators who, with the assistance of a collision reconstruction expert from the Sûreté du Québec, were tasked with shedding light on this event. During the initial deployment, the team arrived on the scene at approximately 1:55&nbsp;p.m. on June&nbsp;7,&nbsp;2018, and completed the scene examination at approximately 4:47&nbsp;p.m.</p> <p class="text-justify">In this case, the BEI collected testimony from ten civilian witnesses, including a paramedic and the injured person. It also analyzed the facts reported by the police officer involved and the witness police officer.</p> <p class="text-justify">All requirements regarding the timeframe for meeting with the involved police officers and the witness police officer, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were met, taking into account the specific circumstances of the case.</p> <p class="text-justify">Since it remains impossible to determine with certainty the exact time at which the police service received confirmation of the nature of the civilian’s injuries, it is therefore impossible to determine whether the obligations of the witness police officer, the involved police officer, and the chief of the police service, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were met.</p> <p class="text-justify">The content of all interviews was submitted to the DPCP.</p> <p class="text-justify">The BEI investigation report included, among other things&nbsp;:</p> <ul><li><p class="text-justify"><span>The statements of the involved police officer and the witness police officer, required by the Regulation</span></p></li><li><p class="text-justify"><span>Reports from the Kativik Regional Police Service concerning the event</span></p></li><li><p class="text-justify"><span>Various expert reports deemed necessary, including the collision reconstruction report</span></p></li><li><p class="text-justify"><span>Relevant personal information concerning the civilian involved</span></p></li><li><p class="text-justify">Scene examination reports</p></li><li><p class="text-justify"><span>Reports on the control and tracking of seized items</span></p></li><li><p class="text-justify"><span>All notes taken by BEI investigators regarding the case</span></p></li></ul> <p class="text-justify">In addition, the BEI designated an investigator to serve as a liaison with the civilian involved throughout the process, ensuring they were kept informed of the progress and outcome of the investigation.</p> <p class="text-justify"><i>The mission of the Bureau des enquêtes indépendantes is to fully shed light on the facts surrounding police interventions. The BEI investigates all cases in which a person other than an on-duty police officer dies, suffers a serious injury, or is injured by a firearm discharged by a police officer during a police intervention or while in police custody.</i></p>

<p><i>English will follow</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Umiujaq le 3 avril 2018 au cours duquel une civile de 48 ans a été blessée gravement lors d'une intervention policière du Corps&nbsp; de police régional Kativik.</p> <p>L’enquête démontre les faits suivants&nbsp;:</p> <p>Vers 16 h 50 le 3 avril 2018, un appel est logé au poste de police concernant une femme qui dit être en possession de couteaux et affirme vouloir blesser des gens. Deux policiers se rendent sur les lieux et localisent la civile. Elle tient un couteau dans sa main droite et prend la fuite vers une maison située à proximité en apercevant la voiture de police. Avec son véhicule le policier tente de bloquer l’accès de la femme à la maison et entre en collision avec elle, la coinçant entre sa voiture et un amoncellement de neige. La civile est blessée et transportée au dispensaire, puis dans un hôpital de Montréal. Le 4 avril le BEI est avisé de l’événement. Les faits relatés stipulent que la dame a un bras cassé, blessure qui ne correspond pas à la définition de blessure grave au sens du Règlement et qui explique que le BEI ne déclenche alors pas d’enquête. Le 5 juin 2018, le BEI est informé que la femme est toujours hospitalisée à Montréal et qu’elle souffre de blessures beaucoup plus sérieuses. Après vérifications, le BEI déclenche une enquête indépendante.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales le 20 mars 2018. C’est sur la base de ce rapport que le DPCP déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.</p> <p>Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. Conséquemment, aucune autre information sur les faits ou sur l’enquête ne sera divulguée par le BEI.</p> <p><i>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu'un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d'une intervention policière ou durant sa détention par un corps de police.</i></p> <p class="text-justify"><strong>Independent investigation concerning the event that occurred in Umiujaq on April&nbsp;3,&nbsp;2018&nbsp;:&nbsp;the BEI submits its investigation report to the Directeur des poursuites criminelles et pénales</strong></p> <p class="text-justify">The BEI has completed its independent investigation into the circumstances surrounding an event that occurred in Umiujaq on April&nbsp;3,&nbsp;2018, during which a 48-year-old civilian sustained serious injuries during a police intervention by the Kativik Regional Police Force.</p> <p class="text-justify">The investigation revealed the following facts&nbsp;:</p> <p class="text-justify">At approximately 4:50&nbsp;p.m. on April&nbsp;3,&nbsp;2018, a call is made to the police station regarding a woman who states that she is in possession of knives and claims that she intends to harm people. Two police officers are dispatched to the scene and located the civilian. She is holding a knife in her right hand and flees toward a nearby house upon seeing the police vehicle. Using his vehicle, one of the police officers attempts to block the woman’s access to the house and collides with her, pinning her between the police vehicle and a snowbank. The civilian is injured and is transported to the local clinic, then to a hospital in Montreal.</p> <p class="text-justify">On April&nbsp;4, the BEI is notified of the event. The reported facts state that the woman has a broken arm, an injury that does not meet the definition of a serious injury under the Regulations, which explains why the BEI did not initiate an investigation at that time. On June&nbsp;5,&nbsp;2018, the BEI was informed that the woman is still hospitalized in Montreal and is suffering from much more serious injuries. After verification, the BEI initiates an independent investigation.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) on March&nbsp;20,&nbsp;2018. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from the persons involved and witnesses, as well as items of evidence.
