<p><i>English will follow&nbsp;</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Kahnawake au Directeur des poursuites criminelles et pénales le 12 juillet 2019.&nbsp; À la suite de sa décision de ne pas porter d’accusation contre les policiers impliqués, le BEI ferme le dossier BEI-2017-023.</p> <p><strong>Résumé de l’événement</strong></p> <p>Un homme de 28 ans a été blessé gravement lors d’une intervention policière du Service de police de Châteauguay et des Peacekeepers de Kahnawake le jeudi 1^er juin 2017.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales (DPCP).</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement&nbsp;: 01 h 43<br />Heure du signalement au BEI&nbsp;: 03 h 02<br />Déclenchement de l’enquête&nbsp;: 03 h 15</p> <p>Le BEI a déployé huit enquêteurs qui, avec le support de trois experts en reconstitution de collision de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 06 h 05 le 1^er juin 2017 et a terminé l’examen de la scène vers 10 h 30.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de sept témoins civils, incluant des ambulanciers et la personne blessée. Il a également analysé les faits rapportés par les quatre policiers impliqués et les onze policiers autres directement liés à l’événement. &nbsp;</p> <p>Toutes les exigences relatives au délai pour rencontrer les policiers impliqués prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées. Dans ce dossier, il n’y avait aucun policier témoin au sens du Règlement.</p> <p>Les informations obtenues pendant l’enquête permettent de conclure que les obligations des policiers impliqués et des directeurs des corps de police impliqués prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le contenu de toutes les entrevues a été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:<br />-&nbsp;Les comptes rendus des policiers impliqués exigés par le Règlement<br />-&nbsp;Les rapports du Service de police de Châteauguay et des Peacekeepers de Kahnawake concernant l’événement, incluant les cartes d’appels et les enregistrements pertinents des ondes radio<br />-&nbsp;Le dossier de formation des policiers impliqués&nbsp;<br />-&nbsp;Les différents rapports d’expertise jugés nécessaires, notamment en toxicologie<br />-&nbsp;Les informations personnelles pertinentes concernant le civil impliqué&nbsp;<br />- Les séquences vidéo qui concernent l’événement telles que filmées par les caméras de surveillance sur place<br />-&nbsp;Les rapports d’étude de la scène&nbsp;<br />-&nbsp;Les rapports de contrôle et de suivi des pièces saisies<br />-&nbsp;Toutes les notes des enquêteurs du BEI concernant le dossier.<br /><br />De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec le civil impliqué et l’informer de son déroulement et de sa conclusion.</p> <p><i>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</i></p> <p class="text-justify"><strong>Independent investigation into the event that occurred in Kahnawake on June&nbsp;1,&nbsp;2017&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the event that occurred in Kahnawake to the Directeur des poursuites criminelles et pénales on July&nbsp;12,&nbsp;2019. Following the decision not to lay charges against the police officers involved, the BEI is closing file&nbsp;BEI-2017-023.</p> <p class="text-justify"><strong>Summary of the incident</strong></p> <p class="text-justify">A 28-year-old man was seriously injured during a police intervention involving the Châteauguay Police Service and the Kahnawake Peacekeepers on Thursday, June&nbsp;1,&nbsp;2017. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales.</p> <p class="text-justify"><strong>The Independent Investigation</strong></p> <ul><li><p class="text-justify"><span>Time of the event&nbsp;:&nbsp;1:43&nbsp;a.m.</span></p></li><li><p class="text-justify"><span>Time of reporting to the BEI&nbsp;:&nbsp;3:02&nbsp;a.m.</span></p></li><li><p class="text-justify"><span>Time the investigation was launched&nbsp;:&nbsp;3:15&nbsp;a.m.</span></p></li></ul> <p class="text-justify">The BEI deployed eight investigators who, with the assistance of three collision reconstruction experts from the Sûreté du Québec, were tasked with shedding light on this event. During the initial deployment, the team arrived at the scene at approximately 6:05&nbsp;a.m. on June&nbsp;1,&nbsp;2017, and completed the scene examination at approximately 10:30&nbsp;a.m.</p> <p class="text-justify">In this case, the BEI collected testimony from seven civilian witnesses, including paramedics and the injured individual. It also analyzed the accounts provided by the four police officers involved and the eleven other police officers directly connected to the event.</p> <p class="text-justify">All requirements regarding the timeframe for meeting with the involved police officers, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were met. Un civil aurait été blessé gravement lors d’une poursuite policière qui se serait terminée à Kahnawake.</p> <p>Les renseignements préliminaires communiqués au BEI suggèrent ce qui suit&nbsp;:<br />- Vers 01h15, un ambulancier aurait appelé le Service de police de la Ville de Châteauguay pour dénoncer un conducteur qui semblait avoir les capacités affaiblies<br />- Les policiers auraient localisé le véhicule et l’auraient suivi sur une courte distance, à 70 km/heure dans une zone de 50 km/h<br />- À quelques centaines de mètres des limites de Châteauguay et de Kahnawake, ils auraient actionné les gyrophares<br />- La voiture serait alors entrée sur le territoire de Kahnawake, passant devant un camion des Kahnawake Peacekeepers<br />- Voyant les gyrophares allumés, les Kahnawake Peacekeepers auraient alors enclenché une poursuite qui se serait arrêtée alors que la voiture poursuivie serait entrée dans un commerce, vers 01 h 43<br />- Le passager du véhicule aurait subi des blessures légères alors que le conducteur aurait subi des blessures graves<br />- Au moment de publier ces lignes, l’état de santé du conducteur n’est pas connu<br />&nbsp;</p> <p>L’enquête du BEI permettra notamment de déterminer si ces informations sont exactes.</p> <p>8 enquêteurs du BEI ont été chargés d’enquêter sur cet événement.&nbsp; Ils sont arrivés sur les lieux de l’événement à 06h05.</p> <p>Conformément au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes, le BEI a fait appel à la Sûreté du Québec pour agir comme corps de police de soutien dans cette enquête. A civilian was reportedly seriously injured during a police pursuit that is said to have ended in Kahnawake.</p> <p class="text-justify">Preliminary information provided to the BEI suggests the following&nbsp;:</p> <ul><li><p class="text-justify"><span>At approximately 1:15&nbsp;a.m., a paramedic reportedly contacted the Châteauguay Police Service to report a driver who appeared to be impaired</span></p></li><li><p class="text-justify"><span>Police officers reportedly located the vehicle and are said to have followed it for a short distance at a speed of 70&nbsp;km/h in a 50&nbsp;km/h zone</span></p></li><li><p class="text-justify"><span>A few hundred metres from the boundary between Châteauguay and Kahnawake, they reportedly activated their emergency lights</span></p></li><li><p class="text-justify"><span>The vehicle then reportedly entered the territory of Kahnawake, passing a Kahnawake Peacekeepers truck</span></p></li><li><p class="text-justify"><span>Seeing the emergency lights activated, the Kahnawake Peacekeepers reportedly initiated a pursuit, which reportedly ended when the pursued vehicle entered a business at approximately 1:43&nbsp;a.m</span></p></li><li><p class="text-justify"><span>The passenger of the vehicle reportedly sustained minor injuries, while the driver reportedly sustained serious injuries</span></p></li><li><p class="text-justify"><span>At the time of publication, the driver’s medical condition is unknown</span></p></li></ul> <p class="text-justify">The BEI investigation will determine, among other things, whether these details are accurate.</p> <p class="text-justify">Eight BEI investigators have been assigned to investigate this event.
