<p><i>English will follow&nbsp;</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Kahnawake au Directeur des poursuites criminelles et pénales le 12 juillet 2019.&nbsp; À la suite de sa décision de ne pas porter d’accusation contre les policiers impliqués, le BEI ferme le dossier BEI-2017-023.</p> <p><strong>Résumé de l’événement</strong></p> <p>Un homme de 28 ans a été blessé gravement lors d’une intervention policière du Service de police de Châteauguay et des Peacekeepers de Kahnawake le jeudi 1^er juin 2017.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales (DPCP).</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement&nbsp;: 01 h 43<br />Heure du signalement au BEI&nbsp;: 03 h 02<br />Déclenchement de l’enquête&nbsp;: 03 h 15</p> <p>Le BEI a déployé huit enquêteurs qui, avec le support de trois experts en reconstitution de collision de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 06 h 05 le 1^er juin 2017 et a terminé l’examen de la scène vers 10 h 30.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de sept témoins civils, incluant des ambulanciers et la personne blessée. Il a également analysé les faits rapportés par les quatre policiers impliqués et les onze policiers autres directement liés à l’événement. &nbsp;</p> <p>Toutes les exigences relatives au délai pour rencontrer les policiers impliqués prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées. Dans ce dossier, il n’y avait aucun policier témoin au sens du Règlement.</p> <p>Les informations obtenues pendant l’enquête permettent de conclure que les obligations des policiers impliqués et des directeurs des corps de police impliqués prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le contenu de toutes les entrevues a été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:<br />-&nbsp;Les comptes rendus des policiers impliqués exigés par le Règlement<br />-&nbsp;Les rapports du Service de police de Châteauguay et des Peacekeepers de Kahnawake concernant l’événement, incluant les cartes d’appels et les enregistrements pertinents des ondes radio<br />-&nbsp;Le dossier de formation des policiers impliqués&nbsp;<br />-&nbsp;Les différents rapports d’expertise jugés nécessaires, notamment en toxicologie<br />-&nbsp;Les informations personnelles pertinentes concernant le civil impliqué&nbsp;<br />- Les séquences vidéo qui concernent l’événement telles que filmées par les caméras de surveillance sur place<br />-&nbsp;Les rapports d’étude de la scène&nbsp;<br />-&nbsp;Les rapports de contrôle et de suivi des pièces saisies<br />-&nbsp;Toutes les notes des enquêteurs du BEI concernant le dossier.<br /><br />De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec le civil impliqué et l’informer de son déroulement et de sa conclusion.</p> <p><i>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</i></p> <p class="text-justify"><strong>Independent investigation into the event that occurred in Kahnawake on June&nbsp;1,&nbsp;2017&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the event that occurred in Kahnawake to the Directeur des poursuites criminelles et pénales on July&nbsp;12,&nbsp;2019. Following the decision not to lay charges against the police officers involved, the BEI is closing file&nbsp;BEI-2017-023.</p> <p class="text-justify"><strong>Summary of the incident</strong></p> <p class="text-justify">A 28-year-old man was seriously injured during a police intervention involving the Châteauguay Police Service and the Kahnawake Peacekeepers on Thursday, June&nbsp;1,&nbsp;2017. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales.</p> <p class="text-justify"><strong>The Independent Investigation</strong></p> <ul><li><p class="text-justify"><span>Time of the event&nbsp;:&nbsp;1:43&nbsp;a.m.</span></p></li><li><p class="text-justify"><span>Time of reporting to the BEI&nbsp;:&nbsp;3:02&nbsp;a.m.</span></p></li><li><p class="text-justify"><span>Time the investigation was launched&nbsp;:&nbsp;3:15&nbsp;a.m.</span></p></li></ul> <p class="text-justify">The BEI deployed eight investigators who, with the assistance of three collision reconstruction experts from the Sûreté du Québec, were tasked with shedding light on this event. During the initial deployment, the team arrived at the scene at approximately 6:05&nbsp;a.m. on June&nbsp;1,&nbsp;2017, and completed the scene examination at approximately 10:30&nbsp;a.m.</p> <p class="text-justify">In this case, the BEI collected testimony from seven civilian witnesses, including paramedics and the injured individual. It also analyzed the accounts provided by the four police officers involved and the eleven other police officers directly connected to the event.</p> <p class="text-justify">All requirements regarding the timeframe for meeting with the involved police officers, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were met. <p><i>English will follow&nbsp;</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant un événement survenu à Kahnawake le 1^er juin 2017 au cours duquel un civil de 28 ans a été blessé gravement lors d'une intervention policière du Service de police de Châteauguay et des Peacekeepers de Kahnawake.</p> <p>L’enquête démontre les faits suivants&nbsp;:</p> <p>Le 1er juin 2017, vers 01h15, un ambulancier en devoir appelle le Service de police de Châteauguay pour rapporter un véhicule endommagé et sans plaque d’immatriculation, circulant de façon erratique.<br />Vers 01h41, deux policiers du Service de police de Châteauguay localisent un véhicule correspondant à la description faite sur les ondes radio, immobilisé à un feu de circulation. L’auto-patrouille rejoint le véhicule et se place derrière lui, en activant ses lumières et gyrophares.<br />Le véhicule poursuit alors sa route, suivi par l’auto-patrouille et entre sur le territoire de Kahnawake, passant devant un véhicule des Peacekeepers de Kahnawake. Les deux agents des Peacekeepers se mettent également en poursuite du véhicule fuyard. Vers 01h43, le véhicule fuyard entre en collision avec la façade d’un commerce. Le passager de ce véhicule est blessé légèrement alors que le conducteur est blessé gravement.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales le 12 juillet 2019.&nbsp; C’est sur la base de ce rapport que le DPCP déterminera s’il y a lieu de porter des accusations contre les policiers impliqués.</p> <p>Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve. Conséquemment, aucune autre information sur les faits ou sur l’enquête ne sera divulguée par le BEI.</p> <p><i>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu'un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d'une intervention policière ou durant sa détention par un corps de police.</i></p> <p class="text-justify"><strong>Independent investigation regarding the event that occurred in Kahnawake on June&nbsp;1,&nbsp;2017&nbsp;:&nbsp;the BEI submits its investigation report to the Directeur des poursuites criminelles et pénales</strong></p> <p class="text-justify">The BEI has completed its independent investigation into the circumstances surrounding an event that occurred in Kahnawake on June&nbsp;1,&nbsp;2017, during which a 28-year-old civilian was seriously injured during a police intervention involving the Châteauguay Police Service and the Kahnawake Peacekeepers.</p> <p class="text-justify">The investigation found the following facts&nbsp;:</p> <p class="text-justify">On June&nbsp;1,&nbsp;2017, at approximately 1:15&nbsp;a.m., an on-duty paramedic contacted the Châteauguay Police Service to report a damaged vehicle without a licence plate that was being driven erratically.</p> <p class="text-justify">At approximately 1:41&nbsp;a.m., two police officers from the Châteauguay Police Service located a vehicle matching the description broadcast over the radio, stopped at a traffic light. The patrol car approached the vehicle and positioned itself behind it, activating its emergency lights.</p> <p class="text-justify">The vehicle then continued on its way, followed by the patrol car, and entered the territory of Kahnawake, passing a Kahnawake Peacekeepers vehicle. The two Peacekeepers officers also initiated a pursuit of the fleeing vehicle. At approximately 1:43&nbsp;a.m., the fleeing vehicle collided with the façade of a commercial establishment. The passenger of the vehicle sustained minor injuries, while the driver sustained serious injuries.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales on July&nbsp;12,&nbsp;2019. It is based on this report that the DPCP will determine whether charges should be laid against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from the persons involved and witnesses, as well as items of evidence.
