<p><i>English will follow&nbsp;</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Puvirnituq au Directeur des poursuites criminelles et pénales le 16 décembre 2016.&nbsp; À la suite de la décision du Directeur des poursuites criminelles et pénales de ne pas porter d’accusation contre les policiers impliqués, le BEI a fermé le dossier BEI-2016-004.</p> <p><strong>Résumé de l’événement</strong></p> <p>Le passager d’un VTT a été blessé gravement lors d’une intervention policière du Corps de police régional de Kativik à Puvirnituq dans la soirée du dimanche 21 août 2016.&nbsp;La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales.</p> <p><strong>L’enquête indépendante</strong></p> <p>Le BEI a déployé 5 enquêteurs qui, avec le support de 2 techniciens de scène de la Sûreté du Québec, avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 16h00 le 22 août et a quitté Puvirnituq le 24 août en après-midi.</p> <p>Dans ce dossier, le BEI a rencontré 13 témoins civils, incluant l’homme blessé gravement et des ambulanciers, ainsi que les 2 policiers impliqués. &nbsp;<br /><br />Les deux policiers impliqués ont tous été rencontrés dans les délais légaux prévus au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes, soit 48 heures&nbsp;suivant l’arrivée des enquêteurs du BEI sur les lieux de l’événement.&nbsp;Dans ce dossier, il n’y avait aucun policier témoin au sens du Règlement</p> <p>Les informations obtenues pendant l’enquête permettent de conclure que les obligations des policiers impliqués et du directeur du corps de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le contenu de toutes les entrevues a été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:<br /><br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Les comptes-rendus des policiers impliqués exigés par le Règlement<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Le rapport du Corps de police régional de Kativik concernant l’événement<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Les dossiers disciplinaires et dossiers de formations des policiers impliqués<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Les différents rapports d’expertise jugés nécessaires, notamment en toxicologie et en reconstitution de collision<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Les informations personnelles pertinentes concernant le civil blessé gravement<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Des séquences vidéos de l’intervention, telles que filmées par les caméras de surveillances sur place<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Le rapport d’étude de la scène<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Les rapports de contrôle et de suivi des pièces saisies<br />-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Les extraits pertinents des calepins de notes des enquêteurs du BEI<br /><br />De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec le civil impliqué et sa famille et l’informer du déroulement ainsi que de la conclusion de celle-ci.</p> <p>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne autre qu’un policier en service, décède ou subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</p> <p class="text-justify"><strong>Independent investigation regarding the event that occurred in Puvirnituq on&nbsp;August&nbsp;21,&nbsp;2016&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report concerning the event that occurred in Puvirnituq to the Directeur des poursuites criminelles et pénales on December&nbsp;16,&nbsp;2016. Following the decision of the Directeur des poursuites criminelles et pénales not to lay charges against the police officers involved, the BEI closed file BEI-2016-004.</p> <p class="text-justify"><strong>Summary of the Event</strong></p> <p class="text-justify">The passenger of an all-terrain vehicle (ATV) was seriously injured during a police intervention by the Kativik Regional Police Force in Puvirnituq on the evening of Sunday, August&nbsp;21,&nbsp;2016. The factual sequence of events is outlined in the press release issued by the Directeur des poursuites criminelles et pénales.</p> <p class="text-justify"><strong>The Independent Investigation</strong></p> <p class="text-justify">The BEI deployed five investigators who, with the assistance of two crime scene technicians from the Sûreté du Québec, were tasked with shedding light on this event. During the initial deployment, the team arrived at the scene at approximately 4:00&nbsp;p.m. on August&nbsp;22 and left Puvirnituq on the afternoon of August&nbsp;24.</p> <p class="text-justify">In this case, the BEI met with 13&nbsp;civilian witnesses, including the seriously injured man and paramedics, as well as the two police officers involved.</p> <p class="text-justify">Both police officers involved were interviewed within the legal time limits set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, namely within 48&nbsp;hours following the arrival of BEI investigators at the scene of the event. Le bilan d’enquête suivant la procédure habituelle sera publié lorsque ces procédures criminelles seront terminées.</p> <p class="text-justify"><strong>Independent investigation regarding the event that occurred in Puvirnituq&nbsp;:&nbsp;the DPCP announces that no charges will be laid</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the event that occurred in Puvirnituq to the Directeur des poursuites criminelles et pénales. Following the DPCP’s decision not to lay charges against the police officers involved, the BEI is closing file&nbsp;BEI-2016-004.</p> <p class="text-justify">Since charges have been laid against a civilian involved in the police intervention and the case is still before the courts, the BEI will not release further information at this time in order to avoid compromising the fairness and integrity of the judicial process. The investigation summary, prepared in accordance with standard procedure, will be published once these criminal proceedings have concluded.</p>

<p><i>English will follow</i></p> <p>Le BEI a complété son enquête indépendante sur les circonstances entourant l’événement survenu à Puvirnituq le 21 août 2016, au cours duquel un civil a été blessé gravement lors d’une intervention policière.</p> <p>L’enquête démontre les faits suivants:</p> <p>Le dimanche 21 août, peu après 21 h 00, des policiers du Corps de police régional de Kativik ont reçu 2 appels concernant 2 personnes qui prenaient place sur un véhicule tout terrain (VTT) et qui auraient tenté de frapper un groupe de civils.&nbsp;</p> <p>Les policiers ont localisé le véhicule tout terrain et ont constaté que ni la conductrice ni le passager ne portaient de casque. La conductrice s’est dirigée vers l’auto-patrouille et l’a percutée à 2 reprises avant d’accélérer pour quitter les lieux.&nbsp; Une poursuite est alors engagée par les policiers. Une manœuvre de la conductrice a provoqué une collision entre le VTT et l’auto-patrouille. La conductrice ainsi que le passager ont été éjectés.&nbsp; Cette dernière a subi des blessures mineures alors que le passager a été blessé gravement.</p> <p>Conformément à la Loi sur la police, le BEI a transmis son rapport au Directeur des poursuites criminelles et pénales le 16 décembre 2016.&nbsp; C’est sur la base de ce rapport que le <a class="dpnglossary link" href="https://www.bei.gouv.qc.ca/actualites/detail.html#DPCP" title="Directeur des poursuites criminelles et pénales">DPCP</a> déterminera s’il a des motifs raisonnables de porter des accusations contre les policiers impliqués.</p> <p>Rappelons que le rapport produit par le BEI n’est pas public puisqu’il contient des renseignements sensibles et nominatifs, des déclarations des personnes impliquées et des témoins de même que des éléments de preuve.&nbsp; Conséquemment, aucune autre information sur les faits de même que sur l’enquête ne sera divulguée par le BEI.</p> <p class="text-justify"><strong>Independent investigation regarding the event that occurred in Puvirnituq&nbsp;:&nbsp;the BEI submits its investigation report to the Directeur des poursuites criminelles et pénales</strong></p> <p class="text-justify">The BEI has completed its independent investigation into the circumstances surrounding the event that occurred in Puvirnituq on August&nbsp;21,&nbsp;2016, in which a civilian was seriously injured during a police intervention.</p> <p class="text-justify">The investigation found the following facts&nbsp;:</p> <p class="text-justify">On Sunday, August&nbsp;21, shortly after 9:00&nbsp;p.m., police officers of the Kativik Regional Police Force received two calls regarding two individuals riding an all-terrain vehicle (ATV) who allegedly attempted to strike a group of civilians.</p> <p class="text-justify">Police officers located the ATV and observed that neither the driver nor the passenger was wearing a helmet. The driver then drove toward the police patrol car and struck it twice before accelerating and leaving the area. Police officers subsequently initiated a pursuit. A maneuver by the driver caused a collision between the ATV and the police vehicle. The driver and the passenger were ejected. The driver sustained minor injuries, while the passenger was seriously injured.</p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its report to the Directeur des poursuites criminelles et pénales (DPCP) on December&nbsp;16,&nbsp;2016. It is based on this report that the DPCP will determine whether there are reasonable grounds to lay charges against the police officers involved.</p> <p class="text-justify">It should be noted that the report produced by the BEI is not public, as it contains sensitive and identifying information, statements from the persons involved and witnesses, as well as items of evidence. Consequently, no further information regarding the facts or the investigation will be disclosed by the BEI.</p>

As such, no further information regarding the nature of the individual’s injuries will be released.</p> <p class="text-justify">The BEI continues to investigate the circumstances surrounding this incident.</p> <p class="text-justify"><i>The mission of the Bureau des enquêtes indépendantes is to conduct investigations, at the request of the Minister of Public Security, in all cases where a person other than an on-duty police officer dies or sustains serious injury, or is injured by a firearm used by a police officer during a police intervention or while in police custody.</i></p>
