À la suite de la décision du DPCP de ne pas porter d’accusation contre les policiers impliqués, et en l’absence de faits nouveaux, le BEI clôt le dossier BEI-221008-001.&nbsp;</p> <p class="text-justify"><strong>Résumé de l’événement</strong>&nbsp;</p> <p class="text-justify">Le 7 octobre 2022, une personne est décédée lors d'une détention impliquant le Eeyou Eenou Police Force (EEPF) et la Sûreté du Québec (SQ). Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 14 h 00, le 9 octobre 2022.&nbsp;</p> <p class="text-justify">Dans ce dossier, le BEI a recueilli le témoignage de deux témoins civils. Il a aussi analysé les faits rapportés par les policiers en relation avec l'intervention.&nbsp;</p> <p class="text-justify">Notez que les exigences relatives au délai prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes n’ont pas été respectées comme prévu par le Eeyou Eenou Police Force (EEPF). L’article 1 (2) du Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes exige des policiers impliqués ou témoins qu’ils rédigent, de manière indépendante, notamment sans consultation et sans influence, un compte rendu et qu’ils le remettent aux enquêteurs du BEI. Dans le dossier cette obligation n’a pas été respectée. Cependant, les autres obligations des policiers impliqués et du directeur du service de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p class="text-justify">Le dossier d’enquête comportant les éléments de ce dernier a été remis au DPCP pour analyse et décision. Le dossier comprend les composantes suivantes :&nbsp;</p> <ul><li><p class="text-justify"><span>Les comptes rendus des policiers du EEPF et de la SQ exigés par le Règlement ;&nbsp;</span></p></li><li><p class="text-justify"><span>Les documents du EEPF concernant l’événement tels que le rapport d’événement, le registre des détenus ainsi que la liste des détenus ;&nbsp;</span></p></li><li><p class="text-justify"><span>L’extraction des enregistrements vidéo de caméras effectué par le SPVQ à la demande du BEI ;</span></p></li><li><p class="text-justify"><span>Les différents rapports d’expertises, notamment du service de de pathologie et de toxicologie du LSJML ; &nbsp;</span></p></li><li><p class="text-justify"><span>Toutes les notes des enquêteurs du BEI concernant le dossier.&nbsp;</span></p></li></ul> <p class="text-justify">De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec la famille du civil impliqué et l’informer de son déroulement et de sa conclusion.&nbsp;</p> <p class="text-justify"><i>Le Bureau des enquêtes indépendantes a pour mission de faire la lumière complète sur les faits entourant l’intervention policière. Le BEI enquête dans tous les cas où une personne, autre qu'un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d'une intervention policière ou durant sa détention par un corps de police.</i>&nbsp;</p> <p class="text-justify"><strong>Independent investigation into the incident that occurred in Mistissini on October&nbsp;7,&nbsp;2022&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the incident that occurred in Mistissini to the Directeur des poursuites criminelles et pénales on July&nbsp;17, 2023. Following the DPCP’s decision not to lay charges against the police officers involved, and in the absence of any new information, the BEI is closing file BEI-221008-001.</p> <p class="text-justify"><strong>Summary of the Incident</strong></p> <p class="text-justify">On October&nbsp;7,&nbsp;2022, a person died while in custody involving the the Eeyou Eenou Police Force (EEPF) and the Sûreté du Québec (SQ). During the initial deployment, the team arrived at the scene at approximately 2:00&nbsp;p.m. on October&nbsp;9,&nbsp;2022.</p> <p class="text-justify">In this file, the BEI collected statements from two civilian witnesses. It also analyzed the facts reported by the police officers in relation to the intervention.</p> <p class="text-justify">It should be noted that the time-related requirements provided for in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i> were not met as expected by the Eeyou Eenou Police Force (EEPF). Section 1(2) of the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i> requires involved or witness police officers to write, independently - without consultation or influence, a report and submit it to BEI investigators. In this case, that obligation was not fulfilled. However, the other obligations of the involved police officers and the director of the implicated police service, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were respected.</p> <p class="text-justify">The investigation file, containing all elements of the case, was submitted to the DPCP for analysis and decision. The file includes the following components&nbsp;:</p> <ul><li><p class="text-justify"><span>Police reports from EEPF and SQ, required by the Regulation;</span></p></li><li><p class="text-justify"><span>Documents from the EEPF related to the event, such as the incident report, the detainee register, and the list of detainees;</span></p></li><li><p class="text-justify"><span>Video footage extracted by the SPVQ at the request of the BEI;</span></p></li><li><p class="text-justify"><span>Various expert reports, including those from the forensic pathology and toxicology services of the LSJML;</span></p></li><li><p class="text-justify"><span>All notes taken by BEI investigators regarding the case.</span></p></li></ul> <p class="text-justify">In addition, the BEI appointed an investigator to serve as liaison with the family of the civilian involved throughout the process, ensuring they were kept informed of the progress and outcome of the investigation.</p> <p class="text-justify"><i>The mission of the Bureau des enquêtes indépendantes (BEI) is to shed full light on the facts surrounding police interventions. <p><i>English will follow</i></p> <p>Le BEI déclenche une enquête indépendante sur les circonstances d’une intervention impliquant le Service de police de&nbsp;Eeyou Eenou (EEPF) et la Sûreté du Québec (SQ).</p> <p>Les renseignements préliminaires communiqués au BEI suggèrent ce qui suit :</p> <ul><li>Le&nbsp;7 octobre 2022, vers&nbsp;21 h 35, les policiers du EEPF auraient procédé à l’arrestation d’un homme qui aurait été intoxiqué et désorganisé.
