À la suite de la décision du<a href="https://www.quebec.ca/nouvelles/actualites/details/enquete-independante-sur-levenement-survenu-a-kuujjuaq-le-18-decembre-2021-le-dpcp-ne-portera-pas-daccusation-48861 _blank external-link-new-window "> DPCP</a> de ne pas porter d’accusation contre le policier, et en l’absence de faits nouveaux, le BEI clôt le dossier.</p> <p><strong>Résumé de l’événement</strong></p> <p>Le 18 décembre 2021, une personne est décédée lors d’une intervention impliquant le Service de police du Nunavik (SPN). La trame factuelle de cet événement est relatée dans le communiqué du Directeur des poursuites criminelles et pénales.</p> <p><strong>L’enquête indépendante</strong></p> <p>Heure de l’événement : 16 h 54, le 18 décembre</p> <p>Heure du signalement au BEI : 17 h 57, le 18 décembre</p> <p>Déclenchement de l’enquête : 19 h 00, le 18 décembre</p> <p>Le BEI a déployé cinq (5) enquêteurs qui avaient la tâche de faire la lumière sur cet événement.</p> <p>Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 11 h 45 le 19 décembre 2021. L’examen de la scène a été effectué par le technicien en identité judiciaire du BEI et aucun service de soutien n’a été requis.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage d’un témoin civil. Il a aussi analysé les faits rapportés par les policiers en relation avec l’intervention.</p> <p>Les informations obtenues pendant l’enquête permettent de conclure que les obligations du policier impliqué et du directeur du Service de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le contenu de toutes les entrevues ainsi que le dossier d’enquête au complet ont été remis au DPCP.</p> <p>Le rapport d’enquête du BEI comprenait notamment:</p> <p>• Les comptes rendus du policier exigés par le Règlement;</p> <p>• Les rapports du Service de police du Nunavik (SPN) concernant l’événement;</p> <p>• Le rapport d’analyse de la scène effectué par le technicien en identité judiciaire du BEI;</p> <p>• Les rapports d’expertise du Laboratoire de sciences judiciaires et de médecine légale;</p> <p>• La déclaration recueillie du témoin rencontré;</p> <p>• Toutes les notes des enquêteurs du BEI concernant le dossier.</p> <p>De plus, le BEI a désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec la famille du civil impliqué et l’informer de son déroulement ainsi que de sa conclusion.</p> <p><i>Le Bureau des enquêtes indépendantes a pour mission de faire enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</i></p> <p class="text-justify"><strong>Independent investigation into the incident that occurred in Kuujjuaq on December&nbsp;18, 2021&nbsp;:&nbsp;Summary of the BEI investigation process following the DPCP’s decision.</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the incident that occurred in Kuujjuaq to the Directeur des poursuites criminelles et pénales on July&nbsp;7,&nbsp;2022. Following the&nbsp;<a href="https://www.quebec.ca/nouvelles/actualites/details/enquete-independante-sur-levenement-survenu-a-kuujjuaq-le-18-decembre-2021-le-dpcp-ne-portera-pas-daccusation-48861">DPCP</a>’s decision not to lay charges against the police officers involved, and in the absence of any new information, the BEI is closing file.</p> <p class="text-justify"><strong>Summary of the Incident</strong></p> <p class="text-justify">On December&nbsp;18,&nbsp;2021, a person died during an intervention involving the Nunavik Police Service (NPS). During the initial deployment, the team arrived at the scene at approximately 11:45&nbsp;a.m. on December&nbsp;19,&nbsp;2021. The scene examination was carried out by the BEI’s forensic identity technician, and no support services were required.</p> <p class="text-justify">In this file, the BEI collected statement from one civilian witnesses. It also analyzed the facts reported by the police officers in relation to the intervention.</p> <p class="text-justify">The information gathered during the investigation indicates that the obligations of the police officers involved, as well as those of the Chief of Police, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were duly respected.</p> <p class="text-justify">The contents of all interviews as well as the complete investigation file were submitted to the DPCP.</p> <p class="text-justify">The BEI investigation report included, in particular:</p> <ul><li><p class="text-justify"><span>Police reports, required by the Regulation;</span></p></li><li><p class="text-justify"><span>Reports from the Nunavik Police Service (NPS) concerning the incident;</span></p></li><li><p class="text-justify"><span>The scene analysis report prepared by the BEI’s forensic identity technician;</span></p></li><li><p class="text-justify">Expert reports from the Laboratoire de sciences judiciaires et de médecine légale;</p></li><li><p class="text-justify"><span>The statement obtained from the civilian witness interviewed;</span></p></li><li><p class="text-justify"><span>All notes taken by BEI investigators regarding the case.</span></p></li></ul> <p class="text-justify">In addition, the BEI appointed an investigator to serve as liaison with the family of the civilian involved throughout the process, ensuring they were kept informed of the progress and outcome of the investigation.</p> <p class="text-justify"><i>The mission of the Bureau des enquêtes indépendantes (BEI) is to shed full light on the facts surrounding police interventions.
