<p><i>English will follow&nbsp;</i></p> <p>Conformément à la Loi sur la police, le BEI a remis son rapport d’enquête sur l’événement survenu à Kuujjuarapik au Directeur des poursuites criminelles et pénales le 4 juillet 2023. À la suite de la décision du DPCP de ne pas porter d’accusation contre les policiers impliqués, et en l’absence de faits nouveaux, le BEI clôt le dossier BEI-220818-001.</p> <p><strong>Résumé de l’événement</strong></p> <p>Le 17 août 2022, une personne a été gravement blessée lors d’une intervention impliquant le Corps de police régional de Kativik (CPRK). La trame factuelle de cet événement est relatée dans <a href="https://www.quebec.ca/nouvelles/actualites/details/enquete-independante-sur-levenement-survenu-a-kuujjuarapik-le-17-aout-2022-le-dpcp-ne-portera-pas-daccusation-52817">le communiqué du Directeur des poursuites criminelles et pénales.</a></p> <p><strong>L’enquête indépendante</strong></p> <p>• Heure de l’événement : 22 h 00, le 17 août 2022</p> <p>• Heure du signalement au BEI : 00 h 22, le 18 août 2022</p> <p>• Déclenchement de l’enquête : 00 h 30, le 18 août 2022&nbsp;</p> <p>Le BEI a déployé quatre enquêteurs qui avaient la tâche de faire la lumière sur cet événement. Lors du déploiement initial, l’équipe est arrivée sur les lieux vers 8 h 15, le 19 août 2022.</p> <p>Dans ce dossier, le BEI a recueilli le témoignage de quatre témoins civils. Il a aussi analysé les faits rapportés par les policiers en relation avec l’intervention.</p> <p>Les informations obtenues pendant l’enquête permettent de conclure que les obligations des policiers impliqués et du directeur du Service de police impliqué prévues au Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes ont été respectées.</p> <p>Le dossier d’enquête comportant les éléments de ce dernier a été remis au DPCP pour analyse et décision. Le dossier comprend les composantes suivantes :</p> <p>• Les comptes rendus des policiers du CPRK exigés par le Règlement ;</p> <p>• Les documents du CPRK concernant l’événement tel que le rapport d’évènement, le rapport d’enquête et les enregistrement vidéo issue d’une caméra corporelle ;</p> <p>• Les différents rapports d’expertises, tels que le rapport de balistique judiciaire du LSJML ;</p> <p>• Le rapport du technicien en identité judiciaire du SPVM, corps de police de soutien, qui a effectué la scène et les notes de l’enquêteur de scène du BEI ;</p> <p>• Toutes les notes des enquêteurs du BEI concernant le dossier.</p> <p>De plus, le BEI avait désigné un enquêteur pour assurer, tout au long de l’enquête, la liaison avec le civil impliqué et l’informer de son déroulement et de sa conclusion.</p> <p><i>Le Bureau des enquêtes indépendantes a pour mission de faire la lumière complète sur les faits entourant l’intervention policière. Le BEI enquête dans tous les cas où une personne, autre qu’un policier en service, décède, subit une blessure grave ou est blessée par une arme à feu utilisée par un policier lors d’une intervention policière ou durant sa détention par un corps de police.</i></p> <p class="text-justify"><strong>Independent investigation into the incident that occurred in Kuujjuarapik on August&nbsp;17,&nbsp;2022&nbsp;:&nbsp;Summary of the BEI investigation process</strong></p> <p class="text-justify">In accordance with the <i>Police Act</i>, the BEI submitted its investigation report on the incident that occurred in Kuujjuarapik to the Directeur des poursuites criminelles et pénales on July&nbsp;4,&nbsp;2023. Following the DPCP’s decision not to lay charges against the police officers involved, and in the absence of any new information, the BEI is closing file BEI-2022-035.</p> <p class="text-justify"><strong>Summary of the Incident</strong></p> <p class="text-justify">On August&nbsp;17,&nbsp;2022, a person was seriously injured during an intervention involving the Nunavik Police Service. During the initial deployment, the team arrived at the scene at approximately 8:15&nbsp;a.m. on August&nbsp;19,&nbsp;2022.</p> <p class="text-justify">In this file, the BEI collected statements from four civilian witnesses. It also analyzed the facts reported by the police officers in relation to the intervention.</p> <p class="text-justify">The information gathered during the investigation indicates that the obligations of the police officers involved, as well as those of the Chief of Police, as set out in the <i>Règlement sur le déroulement des enquêtes du Bureau des enquêtes indépendantes</i>, were duly respected.</p> <p class="text-justify">The investigation file, containing all elements of the case, was submitted to the DPCP for analysis and decision. The file includes the following components&nbsp;:</p> <ul><li><p class="text-justify"><span>Police reports from the NPS, required by the Regulation;</span></p></li><li><p class="text-justify"><span>Documents from the NPS related to the event, such as the incident report, the investigation report, and video recordings from a body-worn camera;</span></p></li><li><p class="text-justify"><span>Various expert reports, including the judicial ballistics report from the LSJML;</span></p></li><li><p class="text-justify"><span>The report from the forensic identification technician of the SPVM, the supporting police service, who processed the scene, as well as the BEI scene investigator’s notes;</span></p></li><li><p class="text-justify"><span>All notes taken by BEI investigators regarding the case.</span></p></li></ul> <p class="text-justify">In addition, the BEI appointed an investigator to serve as liaison with the civilian involved throughout the process, ensuring they were kept informed of the progress and outcome of the investigation.</p> <p class="text-justify"><i>The mission of the Bureau des enquêtes indépendantes (BEI) is to shed full light on the facts surrounding police interventions.
